Zorunlu nedenlerle i\u015fin durmas\u0131, ulusal bayram ve genel tatillerden \u00f6nce veya sonra i\u015fyerinin tatil edilmesi veya benzer nedenlerle i\u015fyerinde normal \u00e7al\u0131\u015fma s\u00fcrelerinin \u00f6nemli \u00f6l\u00e7\u00fcde alt\u0131nda \u00e7al\u0131\u015f\u0131lmas\u0131 veya tamamen tatil edilmesi ya da i\u015f\u00e7inin talebi ile kendisine izin verilmesi hallerinde, i\u015fyerinde \u00e7al\u0131\u015fman\u0131n durmas\u0131 sebebiyle ortaya \u00e7\u0131kan eksik \u00e7al\u0131\u015fma s\u00fcresini telafi etmek isteyen i\u015fveren, iki ay i\u00e7inde kanun ve y\u00f6netmelikte belirtilen \u015fekilde i\u015f\u00e7iyi normal \u00e7al\u0131\u015fma s\u00fcresinin d\u0131\u015f\u0131nda \u00e7al\u0131\u015ft\u0131rma hakk\u0131na sahiptir. Telafi \u00e7al\u0131\u015fmas\u0131n\u0131n yasal s\u0131n\u0131rlar i\u00e7inde en fazla ne kadar ve nas\u0131l yap\u0131laca\u011f\u0131 a\u015fa\u011f\u0131daki yaz\u0131m\u0131zda detayl\u0131 olarak incelenmektedir. <\/em><\/strong><\/p>\n<p><strong><u>A\u00c7IKLAMALAR:<\/u><\/strong><\/p>\n<p>4857 Say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 64. Maddesi uyar\u0131nca \u201cZorunlu nedenlerle i\u015fin durmas\u0131, ulusal bayram ve genel tatillerden \u00f6nce veya sonra i\u015fyerinin tatil edilmesi veya benzer nedenlerle i\u015fyerinde normal \u00e7al\u0131\u015fma s\u00fcrelerinin \u00f6nemli \u00f6l\u00e7\u00fcde alt\u0131nda \u00e7al\u0131\u015f\u0131lmas\u0131 veya tamamen tatil edilmesi ya da i\u015f\u00e7inin talebi ile kendisine izin verilmesi hallerinde, i\u015fveren iki ay i\u00e7inde \u00e7al\u0131\u015f\u0131lmayan s\u00fcreler i\u00e7in telafi \u00e7al\u0131\u015fmas\u0131 yapt\u0131rabilir\u201d denilmektedir. Yine ayn\u0131 \u015fekilde 06.04.2014 tarih 25425 say\u0131l\u0131 resmi gazetede yay\u0131mlanan \u0130\u015f Kanuna \u0130li\u015fkin \u00c7al\u0131\u015fma S\u00fcreleri Y\u00f6netmeli\u011fi\u2019nde telafi \u00e7al\u0131\u015fmas\u0131 \u201cZorunlu nedenlerle i\u015fin durmas\u0131, ulusal bayram ve genel tatillerden \u00f6nce veya sonra i\u015fyerinin tatil edilmesi veya benzer nedenlerle i\u015fyerinde normal \u00e7al\u0131\u015fma s\u00fcrelerinin \u00f6nemli \u00f6l\u00e7\u00fcde alt\u0131nda \u00e7al\u0131\u015f\u0131lmas\u0131 veya tamamen tatil edilmesi ya da i\u015f\u00e7inin talebi ile kendisine 4857 say\u0131l\u0131 \u0130\u015f Kanunu, i\u015f s\u00f6zle\u015fmeleri ve toplu i\u015f s\u00f6zle\u015fmeleri ile \u00f6ng\u00f6r\u00fclen yasal izinleri d\u0131\u015f\u0131nda izin verilmesi hallerinde, i\u015f\u00e7inin \u00e7al\u0131\u015fmad\u0131\u011f\u0131 bu s\u00fcrelerin telafisi i\u00e7in i\u015f\u00e7iye yapt\u0131r\u0131lacak \u00e7al\u0131\u015fma\u201d olarak tan\u0131mlanm\u0131\u015ft\u0131r.<\/p>\n<p>Yukar\u0131da belirtilen kanun ve y\u00f6netmelik maddelerinde a\u00e7\u0131kland\u0131\u011f\u0131 \u00fczere; kanunda say\u0131lan \u00e7e\u015fitli nedenlerden kaynaklanan, \u00e7al\u0131\u015f\u0131lmayan s\u00fcrelerin yerine mesai yap\u0131lmas\u0131, telafi \u00e7al\u0131\u015fmas\u0131 olarak adland\u0131r\u0131lmaktad\u0131r.<\/p>\n<p>\u0130lgili mevzuatlar incelendi\u011finde telafi \u00e7al\u0131\u015fmas\u0131 yap\u0131labilmesi i\u00e7in \u00fc\u00e7 ana neden say\u0131lm\u0131\u015ft\u0131r. Bunlardan ilki zorunlu nedenlerle i\u015fin durmas\u0131d\u0131r. Buradaki zorunlu nedenler kavram\u0131 net olarak ifade edilememek ile birlikte her somut durum \u00f6zelinde geni\u015f anlamda de\u011ferlendirilmeli, ancak sadece ve sadece zorlay\u0131c\u0131 (m\u00fccbir sebep) olarak anla\u015f\u0131lmamal\u0131d\u0131r. Deprem, sel, su ta\u015fk\u0131nlar\u0131, toprak kaymalar\u0131 ve yang\u0131nlar vb. \u015feklindeki do\u011fal afetler veya i\u015fyerinde kaynakl\u0131 ba\u015fkaca zorunlu nedenlerin ortaya \u00e7\u0131kmas\u0131, \u00f6rne\u011fin i\u015fyerindeki \u00fcretim makinalar\u0131n bak\u0131m ve onar\u0131m\u0131 nedeniyle \u00e7al\u0131\u015f\u0131lamamas\u0131, i\u015fyerinin bulundu\u011fu b\u00f6lgede uzun s\u00fcreli elektrik kesintilerinin olmas\u0131 nedeniyle i\u015fyerinin o g\u00fcn tatil edilmesi durumda \u00e7al\u0131\u015f\u0131lmayan s\u00fcrelerin kar\u015f\u0131l\u0131\u011f\u0131nda i\u015fverenin telafi \u00e7al\u0131\u015fmas\u0131 yapt\u0131rma hakk\u0131 bulunmaktad\u0131r.<\/p>\n<p>Kanunda telafi \u00e7al\u0131\u015fmas\u0131 yap\u0131lmas\u0131n\u0131 m\u00fcmk\u00fcn k\u0131lan ikinci durum bayram ve genel tatillerden \u00f6nce veya sonra i\u015fyerinin tatil edilmesidir. \u00a0\u00dclkemizde bayram ve genel tatillerin biti\u015f zaman\u0131n hafta tatiline yak\u0131n bir tarihte olmas\u0131 durumunda i\u015fverenler, mesai yap\u0131lmas\u0131 gereken g\u00fcnleri hafta tatili ile birle\u015ftirerek i\u015fyerinde daha uzun s\u00fcreyle tatil ilan edebilmektedir. Bu durum s\u00f6z konusu oldu\u011funda, 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 64. Maddesinin 1. F\u0131kras\u0131 i\u015fverene, \u00e7al\u0131\u015f\u0131lmayan bu s\u00fcrelerin sonradan \u00e7al\u0131\u015ft\u0131r\u0131larak tamamlanmas\u0131n\u0131 isteme hakk\u0131 vermektedir.<\/p>\n<p>Kanunda i\u015fverene telafi \u00e7al\u0131\u015fmas\u0131 yapt\u0131rabilmesi imk\u00e2n\u0131n\u0131 veren \u00fc\u00e7\u00fcnc\u00fc neden i\u015f\u00e7inin talebi ile kendisine izin verilmesidir. Kanunda belirtilen izin i\u015f\u00e7i \u00f6zelinde verilen idari izin olarak kabul edilmektedir. Ayr\u0131ca i\u015f\u00e7inin talebine istinaden verilen izin kavram\u0131na baz\u0131 istisnalar getirilmi\u015f olup, bu izinler \u201ci\u015f kanunu, i\u015f s\u00f6zle\u015fmesi ve toplu i\u015f s\u00f6zle\u015fmeleri ile \u00f6ng\u00f6r\u00fclen yasal izinler\u201d d\u0131\u015f\u0131nda verilen izinler olarak tan\u0131mlanm\u0131\u015ft\u0131r. \u0130\u015f kanunu, i\u015f s\u00f6zle\u015fmesi ve toplu i\u015f s\u00f6zle\u015fmeleri ile \u00f6ng\u00f6r\u00fclen, i\u015f\u00e7iye verilmesi zorunlu yasal izinlere hafta tatili, anal\u0131k (do\u011fum) izni, babal\u0131k izni,\u00a0 evlenme izni, \u00f6l\u00fcm izni, yeni i\u015f arama izni \u00f6rnek olarak verilebilir. Say\u0131lan bu durumlar\u0131n d\u0131\u015f\u0131nda i\u015fveren i\u015f\u00e7inin idari izin talebini kabul edip, kanunun verdi\u011fi hakka dayanarak i\u015f\u00e7inin \u00e7al\u0131\u015fmad\u0131\u011f\u0131 bu s\u00fcrelere ili\u015fkin telafi \u00e7al\u0131\u015fmas\u0131 yapt\u0131rabilir.<\/p>\n<p>\u0130\u015f Kanununa \u0130li\u015fkin \u00c7al\u0131\u015fma S\u00fcreleri Y\u00f6netmeli\u011finin 7. Maddesinin 2. F\u0131kras\u0131 i\u015fverenin telafi \u00e7al\u0131\u015fmas\u0131n\u0131 nas\u0131l yapt\u0131raca\u011f\u0131n\u0131 belirtmi\u015ftir. \u0130lgili y\u00f6netmelik uyar\u0131nca, telafi \u00e7al\u0131\u015fmas\u0131 yapt\u0131racak i\u015fveren, bu \u00e7al\u0131\u015fman\u0131n \u0130\u015f Kanunu\u2019nun 64. Maddesinde say\u0131lan hallerden hangisine dayand\u0131\u011f\u0131n\u0131 a\u00e7\u0131k\u00e7a belirtmek ve hangi tarihte \u00e7al\u0131\u015fmaya ba\u015flanaca\u011f\u0131n\u0131 ilgili i\u015f\u00e7ilere bildirmekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n<p>Kanun metninden de anla\u015f\u0131laca\u011f\u0131 gibi, telafi \u00e7al\u0131\u015fmas\u0131 iki ay i\u00e7erisinde yapt\u0131r\u0131labilmekte ve yap\u0131lan telafi \u00e7al\u0131\u015fmalar\u0131 fazla \u00e7al\u0131\u015fma veya fazla s\u00fcrelerle \u00e7al\u0131\u015fma olarak nitelendirilmemektedir. Ancak burada telafi \u00e7al\u0131\u015fmalar\u0131n\u0131n hangi s\u00fcreyle yapt\u0131r\u0131laca\u011f\u0131 b\u00fcy\u00fck \u00f6nem ta\u015f\u0131maktad\u0131r. \u0130\u015f Kanununa \u0130li\u015fkin \u00c7al\u0131\u015fma S\u00fcreleri Y\u00f6netmeli\u011finin 7. Maddesinin 3. F\u0131kras\u0131 uyar\u0131nca, telafi \u00e7al\u0131\u015fmalar\u0131 g\u00fcnl\u00fck en \u00e7ok \u00e7al\u0131\u015fma s\u00fcresini yani on bir saati a\u015fmamak ko\u015fuluyla uygulanabilmekte ve g\u00fcnde \u00fc\u00e7 saatten fazla da yapt\u0131r\u0131lamamaktad\u0131r. Telafi \u00e7al\u0131\u015fmas\u0131 yapt\u0131rmak isteyen i\u015fveren bunu i\u015fyerinde \u00e7al\u0131\u015f\u0131lan g\u00fcnlere b\u00f6lmek zorundad\u0131r. Yani i\u015fyerinde haftan\u0131n 5 g\u00fcn\u00fc \u00e7al\u0131\u015f\u0131l\u0131yorsa, cumartesi ve pazar g\u00fcnleri telafi \u00e7al\u0131\u015fmas\u0131 yapt\u0131r\u0131lmas\u0131 m\u00fcmk\u00fcn de\u011fildir.
