Buna kar\u015f\u0131n 6217 say\u0131l\u0131 Yarg\u0131 Hizmetlerinin H\u0131zland\u0131r\u0131lmas\u0131\u00a0 Amac\u0131yla Baz\u0131 Kanunlarda De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun\u2019un Ge\u00e7ici 2. Maddesi uyar\u0131nca kirac\u0131n\u0131n, 6102 say\u0131l\u0131 T\u00fcrk Ticaret Kanunu\u2019nda (\u201cTTK\u201d) tacir olarak say\u0131lan ki\u015filer ile \u00f6zel hukuk ve kamu hukuku t\u00fczel ki\u015fileri oldu\u011fu i\u015fyeri kiralar\u0131nda TBK\u2019n\u0131n 323, 325, 331, 340, 342, 343, 344, 346 ve 354 say\u0131l\u0131 Maddelerinin y\u00fcr\u00fcrl\u00fc\u011f\u00fc 8 (sekiz) y\u0131l s\u00fcreyle ertelenmi\u015ftir. Ertelemeye konu 8 (sekiz) y\u0131ll\u0131k s\u00fcre, 01.07.2020 tarihinde sona erecektir. S\u00f6z konusu uygulanmas\u0131 ertelenen maddeler, tekrar erteleme karar\u0131 al\u0131nmad\u0131\u011f\u0131 takdirde 01.07.2020 tarihi itibariyle art\u0131k kirac\u0131s\u0131 tacir olan i\u015fyerleri i\u00e7in de y\u00fcr\u00fcrl\u00fc\u011fe girecektir.<\/p>\n<p>B\u00f6ylece, 01.07.2020\u2019den \u00f6nce ba\u015flam\u0131\u015f ve s\u00fcresi 2020\u2019de dolacak ve dolay\u0131s\u0131yla ilk yenileme d\u00f6nemi 01.07. 2020\u2019den sonraya denk gelecek, kirac\u0131n\u0131n TTK\u2019da tacir olarak say\u0131lan ki\u015filer ile \u00f6zel hukuk ve kamu hukuku t\u00fczel ki\u015fileri oldu\u011fu i\u015fyeri kira s\u00f6zle\u015fmeleri bak\u0131m\u0131ndan TBK\u2019n\u0131n a\u015fa\u011f\u0131da a\u00e7\u0131klanacak olan 9 maddesi ge\u00e7erli olacakt\u0131r.<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li><b> Kira \u0130li\u015fkisinin Devri (TBK m.323)<\/b><\/li>\n<\/ol>\n<p>TBK 323 maddesi uyar\u0131nca; i\u015fyeri kiralar\u0131n\u0131n kirac\u0131 taraf\u0131ndan devri kolayla\u015fm\u0131\u015ft\u0131r. Buna g\u00f6re kirac\u0131, kiraya verenin yaz\u0131l\u0131 r\u0131zas\u0131 almad\u0131k\u00e7a kira ili\u015fkisini ba\u015fkas\u0131na devredemeyecek ancak <b>Kiraya veren de, \u00e7at\u0131l\u0131 olsun olmas\u0131n ayr\u0131m g\u00f6zetmeksizin i\u015fyeri kiralar\u0131nda hakl\u0131 sebep olmad\u0131k\u00e7a kira ili\u015fkisinin ba\u015fkas\u0131na devrine r\u0131za vermekten ka\u00e7\u0131namayacakt\u0131r.<\/b><\/p>\n<p>Ayr\u0131ca madde h\u00fckm\u00fcnde i\u015fyeri kiralar\u0131 bak\u0131m\u0131ndan ayr\u0131 bir d\u00fczenleme yap\u0131lm\u0131\u015f; \u00e7at\u0131l\u0131 olsun olmas\u0131n i\u015fyeri kiralar\u0131nda, kira ili\u015fkisini devreden kirac\u0131, kira s\u00f6zle\u015fmesinin bitimine kadar ve azami 2 y\u0131l boyunca devralan yeni kirac\u0131yla beraber m\u00fcteselsilen sorumlu olacakt\u0131r.<\/p>\n<ol start=\"2\">\n<li><b> Kiralanan\u0131n S\u00f6zle\u015fmenin Bitiminden \u00d6nce Geri Verilmesi (TBK m.325)<\/b><\/li>\n<\/ol>\n<p>Kirac\u0131n\u0131n kiralanan\u0131 s\u00f6zle\u015fme s\u00fcresi bitmeden yahut fesih bildirim s\u00fcrelerine uymadan geri vermesi halinde ise;<\/p>\n<ul>\n<li>Kira s\u00f6zle\u015fmesinden kaynaklanan bor\u00e7lar\u0131, en ba\u015fta da kira bedelini \u00f6deme borcu, kiralanan\u0131n benzer \u015fartlarla kiralanabilece\u011fi makul bir s\u00fcre boyunca devam eder.<\/li>\n<li>Kirac\u0131 bu s\u00fcrenin ge\u00e7mesinden \u00f6nce kiraya verenden kabul etmesi beklenebilecek, \u00f6deme g\u00fcc\u00fcne sahip ve kira ili\u015fkisini devralmaya haz\u0131r yeni bir kirac\u0131 bulmas\u0131 h\u00e2linde, kirac\u0131n\u0131n kira s\u00f6zle\u015fmesinden do\u011fan bor\u00e7lar\u0131 sona erer.<\/li>\n<li>Kiraya veren, yapmaktan kurtuldu\u011fu giderler ile kiralanan\u0131 ba\u015fka bi\u00e7imde kullanmakla elde etti\u011fi veya elde etmekten kasten ka\u00e7\u0131nd\u0131\u011f\u0131 yararlar\u0131 kira bedelinden indirmekle y\u00fck\u00fcml\u00fc olacakt\u0131r.<\/li>\n<\/ul>\n<p>Bu d\u00f6neme kadar olan Mahkeme i\u00e7tihatlar\u0131nda Kira s\u00f6zle\u015fmesinin erken feshi veya kiralanan\u0131n geri verilmesi halinde ta\u015f\u0131nmaz\u0131n benzer ko\u015fullarda kiraya verilebilece\u011fi makul s\u00fcre oran\u0131nda kirac\u0131 aleyhine tazminata h\u00fckmedilmekteydi. S\u00f6z konusu d\u00fczenleme ile gelen en \u00f6nemli de\u011fi\u015fiklik, kiraya verenden kabul etmesi beklenebilecek, \u00f6deme g\u00fcc\u00fcne sahip ve kira ili\u015fkisini devralmaya haz\u0131r yeni bir kirac\u0131 bulunmas\u0131 h\u00e2li olup bu h\u00fck\u00fcmdeki en \u00f6nemli husus \u201ckabul edilebilirlik \u015fart\u0131\u201dd\u0131r.<\/p>\n<p>\u00d6nemle belirtmek isteriz ki, \u00f6zellikle de ticari kiralarda kanun h\u00fckm\u00fc ile getirilen kiraya verenden \u201ckabul etmesi\u201d beklenebilecek kirac\u0131 lafz\u0131n\u0131n her somut olay \u00f6zelinde ayr\u0131 ayr\u0131 de\u011ferlendirilmesi gerekecek ve \u201ckabul edilebilirlik\u201d standard\u0131n\u0131n yorumu mahkeme kararlar\u0131 ve Yarg\u0131tay i\u00e7tihatlar\u0131 ile belirlenecektir.<\/p>\n<ol start=\"3\">\n<li><b> \u00d6nemli Sebeplerle Fesih (TBK m.331)<\/b><\/li>\n<\/ol>\n<p>Ola\u011fan\u00fcst\u00fc fesih sebebi olarak d\u00fczenlenen\u00a0TBK\u2019n\u0131n 331. maddesi, taraflar\u0131n her ikisine de kira ili\u015fkisinin s\u00fcrd\u00fcr\u00fclmesini kendisi i\u00e7in \u00e7ekilmez k\u0131lan \u00f6nemli sebeplerin varl\u0131\u011f\u0131 halinde, s\u00f6zle\u015fmeyi feshetme imk\u00e2n\u0131 tan\u0131m\u0131\u015ft\u0131r.<\/p>\n<p>Bu d\u00fczenleme konut ve \u00e7at\u0131l\u0131 i\u015fyeri kira s\u00f6zle\u015fmelerinde de uygulanabilecek olup, \u00f6nemli sebeplerin varl\u0131\u011f\u0131 halinde taraflar s\u00f6zle\u015fmeyi sona erdirebilir<\/p>\n<p>Ancak s\u00f6zle\u015fmeyi sona erdirmek isteyen kiraya veren, dayand\u0131\u011f\u0131 \u00f6nemli sebebin do\u011fumunda kusurlu bulunmamal\u0131d\u0131r.<\/p>\n<p>Yine s\u00f6z konusu maddede s\u00f6zle\u015fmenin erken feshi sebebiyle, H\u00e2kim; durum ve ko\u015fullar\u0131 g\u00f6z \u00f6n\u00fcnde tutarak, ola\u011fan\u00fcst\u00fc fesih bildirimi neticesinde kendisi taraf\u0131ndan belirlenecek parasal tazminata h\u00fckmedebilecektir.<\/p>\n<p>Bu h\u00fck\u00fcm y\u00fcr\u00fcrl\u00fc\u011fe girene kadar, uygulamada s\u00f6zle\u015fmeyi \u00f6nemli sebeple fesheden taraf tam tazminat \u00f6demekle y\u00fck\u00fcml\u00fc tutulmakta iken, kira s\u00fcresinin 1 (bir) y\u0131ldan fazla olmas\u0131 halinde ise bu tazminat bedeli 6 (alt\u0131) ayl\u0131k kira bedelinden az olamayacak \u015feklindeydi.\u00a0 01.07.2020 tarihi itibar\u0131yla y\u00fcr\u00fcrl\u00fc\u011fe girecek h\u00fck\u00fcm do\u011frultusunda tazminat bedeli h\u00e2kim taraf\u0131ndan taraflar\u0131n somut durumu ve ko\u015fullar dikkate al\u0131narak belirlenecektir.<\/p>\n<ol start=\"4\">\n<li><b> Ba\u011flant\u0131l\u0131 \u0130\u015flem Yapma Yasa\u011f\u0131 (TBK m.340)<\/b><\/li>\n<\/ol>\n<p>Kira s\u00f6zle\u015fmesinin kurulmas\u0131 ya da s\u00fcrd\u00fcr\u00fclmesi, kirac\u0131n\u0131n \u201c<i>kiralanan\u0131n kullan\u0131m\u0131yla do\u011frudan ili\u015fkisi olmayan bir bor\u00e7 alt\u0131na girmesine ba\u011flanm\u0131\u015fsa<\/i>\u201d, kira s\u00f6zle\u015fmesi de\u011fil, kirac\u0131y\u0131 bor\u00e7 alt\u0131nda b\u0131rakan ba\u011flant\u0131l\u0131 s\u00f6zle\u015fme ge\u00e7ersiz olacakt\u0131r. \u00d6rne\u011fin bir ta\u015f\u0131nmaz\u0131n kiralanmas\u0131 i\u00e7in kirac\u0131n\u0131n ayn\u0131 zamanda mal sahibine ait markan\u0131n bayili\u011fini yapmas\u0131 \u015fart\u0131 ko\u015fuluyor ise, bu \u015fekilde bir ba\u011flant\u0131l\u0131 s\u00f6zle\u015fmeden bahsedilebilir.<\/p>\n<p>\u00d6nceki d\u00fczenlemede taraflar kirayla ba\u011flant\u0131l\u0131 s\u00f6zle\u015fme akdedebilmekte ya da taraflar kira s\u00f6zle\u015fmesi i\u00e7erisinde kay\u0131t koyabilmekteydi. Ancak y\u00fcr\u00fcrl\u00fc\u011fe girecek d\u00fczenleme ile kirac\u0131n\u0131n aleyhine akdedilen kirayla ba\u011flant\u0131l\u0131 s\u00f6zle\u015fme veya ba\u015fkaca belgeler ge\u00e7ersiz olacakt\u0131r. Esas olarak bu d\u00fczenleme ile\u00a0 kiraya verenin, kirac\u0131n\u0131n kira s\u00f6zle\u015fmesi yapma gereksiniminden k\u00f6t\u00fc niyetli olarak yararlan\u0131p kira s\u00f6zle\u015fmesinden do\u011fan y\u00fck\u00fcml\u00fcl\u00fckler d\u0131\u015f\u0131nda ona ba\u015fkaca bir bor\u00e7 y\u00fcklemesinin \u00f6n\u00fcne ge\u00e7ilmek istenmi\u015ftir.<\/p>\n<ol start=\"5\">\n<li><b> Kirac\u0131n\u0131n G\u00fcvence (Depozito) Vermesi (TBK m.342)<\/b><\/li>\n<\/ol>\n<p>G\u00fcvence (depozito), kira s\u00f6zle\u015fmesinin ba\u015flang\u0131c\u0131nda kirac\u0131 taraf\u0131ndan kiraya verene teslim edilen ve kirac\u0131n\u0131n kiralanana verebilece\u011fi olas\u0131 zararlar\u0131n teminat\u0131 yerine ge\u00e7en bir miktar para veya k\u0131ymetli evrakt\u0131r. Y\u00fcr\u00fcrl\u00fckten kald\u0131r\u0131lan Bor\u00e7lar Kanunu\u2019nda kirac\u0131n\u0131n depozito vermesine y\u00f6nelik bir d\u00fczenleme bunulmamaktayd\u0131. Ancak uygulamada durum farkl\u0131 olup; hemen her kira s\u00f6zle\u015fmelerinde depozito uygulanmakta ve bu durum Yarg\u0131tay taraf\u0131ndan da ge\u00e7erli kabul edilmektedir. Hayat\u0131n ola\u011fan ak\u0131\u015f\u0131nda yer alan bu d\u00fczenleme hakk\u0131nda kanun h\u00fckm\u00fc bulunmad\u0131\u011f\u0131ndan kanun koyucu d\u00fczenleme yapma ihtiyac\u0131 hissetmi\u015ftir ve TBK\u2019da \u2018\u2019kirac\u0131n\u0131n g\u00fcvence vermesi\u2019\u2019 ba\u015fl\u0131kl\u0131 h\u00fck\u00fcm kurulmu\u015ftur.<\/p>\n<p><b>Bahsi ge\u00e7en h\u00fck\u00fcm uyar\u0131nca; kira s\u00f6zle\u015fmesine y\u00f6nelik g\u00fcvence bedeli verilip verilmemesi taraflar\u0131n iradelerine b\u0131rak\u0131lmakla birlikte, \u015fayet g\u00fcvence verilecekse g\u00fcvence bedelinin azami 3 ayl\u0131k kira bedeli kadar olabilece\u011fi belirtilmi\u015ftir. Kirac\u0131 g\u00fcvence olarak para verdi\u011fi takdirde bu paran\u0131n kiraya verenin onay\u0131 bulunmadan \u00e7ekilemeyece\u011fi vadeli bir tasarruf hesab\u0131na yat\u0131r\u0131lmas\u0131, k\u0131ymetli evrak verdi\u011fi takdirde ise bankaya depo edilmesi zorunlulu\u011fu vard\u0131r<\/b>. Taraflar aksini kararla\u015ft\u0131ramazlar. <b>Banka ise, hesaptaki g\u00fcvenceyi yaln\u0131zca taraflar\u0131n izniyle yahut kesinle\u015fen icra takibi ya da mahkeme karar\u0131na dayanarak geri verebilir.<\/b> Burada g\u00fcvencenin geri verilmesi konusunda bankan\u0131n \u00f6zen y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc bulunmaktad\u0131r.<\/p>\n<p><b>Kiraya veren, kira s\u00f6zle\u015fmesinin sona ermesini izleyen \u00fc\u00e7 ay i\u00e7inde kirac\u0131ya kar\u015f\u0131 kira s\u00f6zle\u015fmesiyle ilgili bir dava a\u00e7t\u0131\u011f\u0131n\u0131 veya icra ya da iflas yoluyla takibe giri\u015fti\u011fini bankaya yaz\u0131l\u0131 olarak bildirmemi\u015fse banka, kirac\u0131n\u0131n istemi \u00fczerine g\u00fcvenceyi geri vermekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/b><\/p>\n<ol start=\"6\">\n<li><b> Kira Bedelinin Belirlenmesi D\u0131\u015f\u0131nda Kirac\u0131 Aleyhine De\u011fi\u015fiklik Yapma Yasa\u011f\u0131 (TBK m.343)<\/b><\/li>\n<\/ol>\n<p>Kanun koyucu \u2018\u2019Kira s\u00f6zle\u015fmelerinde kira bedelinin belirlenmesi d\u0131\u015f\u0131nda, kirac\u0131 aleyhine de\u011fi\u015fiklik yap\u0131lamaz.\u2019\u2019 A\u00e7\u0131klamas\u0131 ile nispi emredici bir h\u00fck\u00fcm kurmu\u015ftur. <b>Buradan anla\u015f\u0131laca\u011f\u0131 \u00fczere <\/b><b>kirac\u0131 taraf\u0131ndan kabul edilmi\u015f dahi olsa<\/b><b> kira s\u00f6zle\u015fmesinde sonradan yap\u0131lan kirac\u0131 aleyhine olan de\u011fi\u015fiklikler kesin h\u00fck\u00fcms\u00fcz olacak ve ge\u00e7erli\u00a0 kabul edilmeyecektir.<\/b><\/p>\n<ol start=\"7\">\n<li><b> Kira Bedelinin Belirlenmesi (TBK m.344)<\/b><\/li>\n<\/ol>\n<p>Konut ve \u00e7at\u0131l\u0131 i\u015fyeri kira s\u00f6zle\u015fmesinin esasl\u0131 unsurlar\u0131ndan olan kira bedeli, s\u00f6zle\u015fme kurulurken taraflarca s\u00f6zle\u015fme serbestisi ilkesi gere\u011fi belirlenmektedir. (Burada her ne kadar s\u00f6zle\u015fme serbestisi olsa dahi emsal kira bedellerinin alt\u0131nda olmas\u0131 halinde taraflar\u0131n emsal kira tutarlar\u0131ndan vergisel anlamda sorumlu olaca\u011f\u0131na ili\u015fkin i\u00e7tihatlar mevcuttur.)<\/p>\n<p>Ba\u015flang\u0131\u00e7ta genellikle belli bir s\u00fcre i\u00e7in akdedilen kira s\u00f6zle\u015fmesi, daha sonra\u00a0TBK m. 347 gere\u011fince birer y\u0131ll\u0131k s\u00fcrelerle yenilenmektedir. Ancak s\u00f6zle\u015fmenin yenilenmesi durumunda kira bedelinde hangi miktarda veya oranda art\u0131\u015f yap\u0131laca\u011f\u0131, taraflar aras\u0131nda \u00e7o\u011fu zaman uyu\u015fmazl\u0131\u011fa yol a\u00e7makta olup yenilenen kira d\u00f6nemlerinde kiraya verenin isteyebilece\u011fi kira bedelinin s\u0131n\u0131rland\u0131r\u0131lmas\u0131, kirac\u0131 lehine olan h\u00fck\u00fcmler aras\u0131nda yer almaktad\u0131r.<\/p>\n<p>Bug\u00fcne kadar i\u015fyeri kiralar\u0131nda taraflar\u0131n s\u00f6zle\u015fme serbest\u00eesi ilkesi \u00e7er\u00e7evesinde serbest\u00e7e belirleyebildi\u011fi kira art\u0131\u015f oran\u0131, art\u0131k TBK ile belirlenen yasal s\u0131n\u0131ra uymak zorunda olup, daha y\u00fcksek oranda kararla\u015ft\u0131r\u0131lan art\u0131\u015flar ge\u00e7ersiz kabul edilecektir.<\/p>\n<p>TBK 344. maddesi ile taraflar\u0131n yenilenen kira d\u00f6nemlerinde uygulanacak kira bedeline ili\u015fkin anla\u015fmalar\u0131n\u0131n, bir \u00f6nceki kira y\u0131l\u0131nda t\u00fcketici fiyat endeksindeki 12 (on iki) ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131n\u0131 ge\u00e7memek ko\u015fuluyla ge\u00e7erli olaca\u011f\u0131 d\u00fczenlenmektedir. S\u00f6z konusu h\u00fck\u00fcm emredici olup bir \u00f6nceki kira y\u0131l\u0131nda t\u00fcketici fiyat endeksindeki 12 (on iki) ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131n\u0131 ge\u00e7en\u00a0 kira art\u0131r\u0131mlar\u0131 ge\u00e7ersiz olacakt\u0131r.<\/p>\n<p><b>Yine s\u00f6z konusu h\u00fck\u00fcm \u00e7er\u00e7evesinde art\u0131k\u00a0 kira bedeli <\/b>yabanc\u0131 para ile belirlenen kira s\u00f6zle\u015fmelerinde ilk 5 y\u0131l i\u00e7inde art\u0131\u015f yap\u0131lamayacak, hatta 5 y\u0131l i\u00e7inde yabanc\u0131 para kurunda a\u015f\u0131r\u0131 y\u00fckselme olmas\u0131 halinde kirac\u0131 a\u015f\u0131r\u0131 ifa g\u00fc\u00e7l\u00fc\u011f\u00fc nedeniyle kira bedelinin uyarlanmas\u0131 davas\u0131 a\u00e7abilecektir. Ancak\u00a0 Kira bedeli yabanc\u0131 para ile belirlenmi\u015f ve 5 y\u0131l\u0131 dolduran kira s\u00f6zle\u015fmelerinde kira bedelinin tespiti mahkemeden talep edilebilecek olup bu durumda mahkeme kiralanan\u0131n durumu, yabanc\u0131 paran\u0131n de\u011ferindeki de\u011fi\u015fiklikler, \u00dcFE oran\u0131 ve emsal kira bedellerini de dikkate alarak yeni bir kira bedeli tespit edecektir.<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"8\">\n<li><b> Kirac\u0131 Aleyhine D\u00fczenleme Yasa\u011f\u0131\/Cezai \u015eart ve Muacceliyet Kay\u0131tlar\u0131n\u0131n Ge\u00e7ersizli\u011fi (TBK m.346)<\/b><\/li>\n<\/ol>\n<p>Konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131na \u00f6zg\u00fc ve emredici nitelikte bir d\u00fczenleme olan TBK\u2019n\u0131n 346. maddesi uyar\u0131nca, kirac\u0131n\u0131n \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc yaln\u0131zca kira bedeli ve yan giderlerle s\u0131n\u0131rl\u0131d\u0131r; kirac\u0131ya ek bir \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc getirilemez.<\/p>\n<p>S\u00f6z konusu d\u00fczenleme ile kirac\u0131n\u0131n, kira bedeli ve yan giderler \u00f6deme d\u0131\u015f\u0131nda ba\u015fka bir \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc bulunmamaktad\u0131r. \u00d6zellikle, i\u015fyeri kira bedelinin zaman\u0131nda \u00f6denmemesi h\u00e2linde cezai \u015fart veya m\u00fcteakip\u00a0 kira bedellerinin muaccel olaca\u011f\u0131na ili\u015fkin s\u00f6zle\u015fme h\u00fck\u00fcmleri\u00a0 art\u0131k ge\u00e7ersiz olacakt\u0131r.<\/p>\n<ol start=\"9\">\n<li><b> Dava Sebeplerinin S\u0131n\u0131rl\u0131l\u0131\u011f\u0131 (TBK m.354)<\/b><\/li>\n<\/ol>\n<p>Kira s\u00f6zle\u015fmelerin dava yoluyla sonland\u0131r\u0131lmas\u0131 TBK\u2019da say\u0131lan sebeplerle s\u0131n\u0131rland\u0131r\u0131lm\u0131\u015ft\u0131r. Bu sebepler TBK m. 350,351 ve 352 de say\u0131lm\u0131\u015f olup ancak bu sebeplerin varl\u0131\u011f\u0131 halinde s\u00f6zle\u015fmenin sonland\u0131r\u0131lmas\u0131 m\u00fcmk\u00fcnd\u00fcr. Bu say\u0131lan sebepler d\u0131\u015f\u0131nda herhangi bir sebebe dayan\u0131larak mahkeme karar\u0131yla s\u00f6zle\u015fme sonland\u0131r\u0131lamayacakt\u0131r. Kanunda yer alan s\u00f6zle\u015fmeyi sona erdirme sebepleri \u015fu \u015fekildedir :<\/p>\n<ul>\n<li>kira s\u00f6zle\u015fmesinin s\u00fcresinin sona ermesi halinde feshi,<\/li>\n<li>kirac\u0131n\u0131n \u00f6l\u00fcm\u00fc \u00fczerine kiraya veren veya kirac\u0131n\u0131n miras\u00e7\u0131lar\u0131 taraf\u0131ndan feshi ile<\/li>\n<li>hakl\u0131 (\u00f6nemli) sebebe dayal\u0131 feshi,<\/li>\n<li>kirac\u0131n\u0131n ifada gecikmesi halinde veya kirac\u0131n\u0131n iflas\u0131 halinde feshi,<\/li>\n<li>kirac\u0131n\u0131n kiralanan\u0131 s\u00f6zle\u015fmeye uygun kullanma, \u00f6zenli kullanma, kom\u015fulara sayg\u0131 g\u00f6sterme vb. bor\u00e7lar\u0131n\u0131n s\u00fcrekli ihlali halinde,<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>Yukar\u0131da belirtilen fesih ve tahliye halleri d\u0131\u015f\u0131nda s\u00f6zle\u015fmeye \u00f6zel h\u00fck\u00fcm konulamayacak, konulsa dahi s\u00f6z konusu h\u00fck\u00fcm ge\u00e7ersiz say\u0131lacakt\u0131r. Yine s\u00f6zle\u015fmede var olan \u00f6zel tahliye ve fesih halleri ge\u00e7ersiz say\u0131lacakt\u0131r.<\/p>\n<p><b>Sonu\u00e7 <\/b><b>\u00a0\u00a0\u00a0 <\/b><b>;<\/b><\/p>\n<p>Bu kapsamda, yukar\u0131da belirtilen h\u00fck\u00fcmlerin y\u00fcr\u00fcrl\u00fc\u011fe 01.07.2020 tarihinde girmesi halinde bu tarih itibariyle akdedilecek yeni s\u00f6zle\u015fmeler ve 01.07.2020 tarihine kadar akdedilmi\u015f i\u015fyeri kira s\u00f6zle\u015fmelerinde \u00f6nemli de\u011fi\u015fiklikler meydana getirecek ve eski s\u00f6zle\u015femlerde yer alan kanuna ayk\u0131r\u0131 h\u00fck\u00fcmlerin de kirac\u0131lar taraf\u0131ndan ge\u00e7ersizli\u011fi iddia edilebilecektir.
