Meslek edinilmemi\u015f \u00f6d\u00fcn\u00e7 i\u015f ili\u015fkisinde m\u00fcteselsil sorumluluk \u00f6ng\u00f6r\u00fclmesine kar\u015f\u0131n, \u00f6zel istihdam b\u00fcrolar\u0131 arac\u0131l\u0131\u011f\u0131yla kurulan \u00f6d\u00fcn\u00e7 i\u015f ili\u015fkisinde \u00f6zel istihdam b\u00fcrosunun sorumlulu\u011fu olduk\u00e7a s\u0131n\u0131rl\u0131 oldu\u011fu s\u00f6ylenebilecektir.\u00a0<\/i><\/b><\/p>\n<p><span style=\"font-weight: 400;\">Bilindi\u011fi \u00fczere \u00f6d\u00fcn\u00e7 i\u015f ili\u015fkisi, genel olarak i\u015fverenin(\u00f6d\u00fcn\u00e7 veren) bir i\u015f\u00e7isinin i\u015f g\u00f6rme edimini ge\u00e7ici bir s\u00fcreli\u011fine bir ba\u015fka i\u015fverenin(\u00f6d\u00fcn\u00e7 alan) emrine vermesiyle kurulan i\u015f ili\u015fkisini ifade etmektedir. \u00dc\u00e7 tarafl\u0131 bir ili\u015fki olan \u00f6d\u00fcn\u00e7 i\u015f ili\u015fkisinde i\u015f\u00e7i, i\u015f g\u00f6rme borcunu esasen aralar\u0131nda s\u00f6zle\u015fmesel ili\u015fki bulunmayan bir i\u015fverene ait i\u015fyerinde ifa etmektedir. Bu bak\u0131mdan i\u015f\u00e7i ile \u00f6d\u00fcn\u00e7 alan i\u015fveren aras\u0131nda kendine \u00f6zg\u00fc bir ili\u015fki bulundu\u011fu s\u00f6ylenebilecektir. \u00d6zel istihdam b\u00fcrolar\u0131 06.05.2016 tarihli \u0130\u015f Kanunu ile T\u00fcrkiye \u0130\u015f Kurumu Kanununda De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun ile 4857 Say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 7. maddesi ile hukukumuza girmi\u015ftir. An\u0131lan d\u00fczenlemenin 11. f\u0131kras\u0131 uyar\u0131nca, \u00f6zel istihdam b\u00fcrosu ile \u00f6d\u00fcn\u00e7 alan i\u015fveren aras\u0131ndaki bir \u201c\u00f6d\u00fcn\u00e7 i\u015f\u00e7i sa\u011flama s\u00f6zle\u015fmesi\u201c ile kurulmaktad\u0131r. \u0130ki tarafa s\u00fcrekli ve kar\u015f\u0131l\u0131kl\u0131 bor\u00e7 y\u00fckleyen bir s\u00f6zle\u015fme olan \u00f6d\u00fcn\u00e7 i\u015f\u00e7i sa\u011flama s\u00f6zle\u015fmesi hukuki nitelik a\u00e7\u0131s\u0131ndan kendine \u00f6zg\u00fc bir niteli\u011fe sahiptir.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Meslek edinilmemi\u015f \u00f6d\u00fcn\u00e7 i\u015f ili\u015fkisinin kurulabilmesi, i\u015f\u00e7inin yaz\u0131l\u0131 onay\u0131n\u0131n al\u0131nmas\u0131na ba\u011fl\u0131d\u0131r. \u0130\u015f\u00e7i yaz\u0131l\u0131 r\u0131zas\u0131n\u0131 devir s\u0131ras\u0131nda vermelidir. Dolay\u0131s\u0131yla devirden \u00f6nce verilen r\u0131zan\u0131n ge\u00e7erlili\u011fi bulunmamaktad\u0131r. Meslek edinilmemi\u015f \u00f6d\u00fcn\u00e7 i\u015f ili\u015fkisi alt\u0131 ay\u0131 ge\u00e7memek \u00fczere kurulabilir ve en fazla iki defa yenilenebilir. Bu s\u00fcrelerin uzat\u0131lmas\u0131 hukuken m\u00fcmk\u00fcn k\u0131l\u0131nmam\u0131\u015ft\u0131r. \u0130\u015fbu s\u00fcrelerin uzat\u0131lmas\u0131 i\u015f\u00e7iyi ba\u011flamayacakt\u0131r. Ancak, s\u00f6zle\u015fmede kararla\u015ft\u0131r\u0131lan ya da en fazla 18 ay olan s\u00f6zle\u015fme s\u00fcresinin sonunda \u00f6d\u00fcn\u00e7 i\u015f\u00e7inin \u00f6d\u00fcn\u00e7 alan i\u015fverenin yan\u0131nda \u00e7al\u0131\u015fmaya devam etmesi halinde, i\u015f\u00e7i an\u0131lan s\u00fcrenin bitiminden itibaren \u00f6d\u00fcn\u00e7 alan\u0131n i\u015f\u00e7isi say\u0131lmal\u0131d\u0131r. S\u00fcrelere riayet edildi\u011fi takdirde ise i\u015f\u00e7inin i\u015fvereni de\u011fi\u015fmemekte, \u00f6d\u00fcn\u00e7 veren i\u015fveren olarak kalmaya aynen devam etmektedir. Yine \u0130\u015f Kanunu m. 7\/15 h\u00fckm\u00fc uyar\u0131nca \u00f6d\u00fcn\u00e7 alan i\u015fveren, i\u015f\u00e7inin \u00f6denmeyen \u00fccreti, sosyal g\u00fcvenlik primleri ve i\u015f\u00e7iyi koruma borcundan i\u015f\u00e7inin kendi b\u00fcnyesinde \u00e7al\u0131\u015ft\u0131\u011f\u0131 s\u00fcre ile s\u0131n\u0131rl\u0131 olmak kayd\u0131yla \u00f6d\u00fcn\u00e7 veren i\u015fverenle birlikte sorumlu tutulmu\u015ftur. Zira s\u00f6z konusu i\u015f ili\u015fkisinde i\u015fverenler aras\u0131nda m\u00fcteselsil sorumluluk \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fcnden \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanunu m. 26 h\u00fckm\u00fc uyar\u0131nca d\u00fczenlenen idari para cezalar\u0131ndan da her iki i\u015fveren de sorumlu olacakt\u0131r.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Meslek edinilmi\u015f \u00f6d\u00fcn\u00e7 i\u015f ili\u015fkisinde \u00f6d\u00fcn\u00e7 veren ise i\u015fveren, \u0130\u015f Kanunu m.7\/11 h\u00fckm\u00fc uyar\u0131nca \u00f6zel istihdam b\u00fcrosudur ve i\u015f\u00e7i esasen i\u015f s\u00f6zle\u015fmesini \u00d6zel \u0130stihdam B\u00fcrosu ile imzalamaktad\u0131r. Meslek edinilmi\u015f \u00f6d\u00fcn\u00e7 i\u015f ili\u015fkisinde, i\u015f s\u00f6zle\u015fmesinin \u015fartlar\u0131 \u00f6zel istihdam b\u00fcrosu taraf\u0131ndan belirlenmekte ancak i\u015f\u00e7i belirli bir s\u00fcreli\u011fine \u00f6d\u00fcn\u00e7 alan i\u015fverenin emir ve talimat\u0131 alt\u0131na girmektedir. \u00d6zel istihdam b\u00fcrosu arac\u0131l\u0131\u011f\u0131yla ge\u00e7ici i\u015f ili\u015fkisi, ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fveren ile ge\u00e7ici i\u015f\u00e7i sa\u011flama s\u00f6zle\u015fmesi yapmak suretiyle yaz\u0131l\u0131 olarak kurulmas\u0131 zorunludur.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u0130\u015f Kanunu m. 7\/9-f bendi uyar\u0131nca, meslek edinilmi\u015f \u00f6d\u00fcn\u00e7 i\u015f ili\u015fkisinde i\u015f\u00e7iyi g\u00f6zetme borcundan, \u00f6d\u00fcn\u00e7 alan i\u015fverenin asli olarak sorumlu oldu\u011fu d\u00fczenlenmi\u015f bulunmaktad\u0131r. Ayn\u0131 zamanda as\u0131l muhatap \u00f6d\u00fcn\u00e7 alan i\u015fveren olsa dahi, i\u015f\u00e7iyi g\u00f6zetme borcu \u00f6zel istihdam b\u00fcrosu a\u00e7\u0131s\u0131ndan da devam etmektedir. Bu bent kapsam\u0131nda \u00f6zel istihdam b\u00fcrosunun sorumlu oldu\u011fu y\u00fck\u00fcml\u00fcl\u00fckler; sa\u011fl\u0131k g\u00f6zetimi, bilgilendirme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc ve denetleme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcd\u00fcr. Ancak di\u011fer yandan \u00f6nemle vurgulamam\u0131z gerekir ki, e\u011fer ki \u00f6d\u00fcn\u00e7 i\u015f\u00e7i \u00f6d\u00fcn\u00e7 alan i\u015fverenin yan\u0131nda \u00e7al\u0131\u015fmas\u0131 gereken s\u00fcre sonland\u0131ktan sonra i\u015f ili\u015fkisine devam eder ise, bu durumda art\u0131k i\u015f\u00e7i ge\u00e7ici i\u015fverenin belirsiz s\u00fcreli i\u015f\u00e7isi olarak kabul edilecektir. \u0130\u015fbu tarihten itibaren art\u0131k ge\u00e7ici i\u015f ili\u015fkisinden kaynaklanan \u00fccretinden, i\u015f\u00e7iyi g\u00f6zetme borcundan ve sosyal sigorta primlerinden \u00f6zel istihdam b\u00fcrosunun sorumlulu\u011fu sona erecekse de, \u00f6zel istihdam b\u00fcrosunun sorumlulu\u011fu ge\u00e7ici i\u015f s\u00f6zle\u015fmesinde kararla\u015ft\u0131r\u0131lan s\u00fcresiyle s\u0131n\u0131rl\u0131 olmak \u00fczere devam edecektir.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u0130\u015f Kanunu m.7\/9-c bendi gere\u011fi ge\u00e7ici i\u015fveren, i\u015f kazas\u0131 ve meslek hastal\u0131\u011f\u0131 hallerini \u00f6zel istihdam b\u00fcrosuna derhal, Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanunu\u2019nda belirtilen mercilere ise s\u00fcresi i\u00e7inde bildirmekle y\u00fck\u00fcml\u00fcd\u00fcr. Zira i\u015f kazas\u0131 halinde sigortal\u0131 yahut sigortal\u0131n\u0131n \u00f6l\u00fcm\u00fc halinde hak sahiplerinin sosyal sigorta yard\u0131mlar\u0131ndan yararlanabilmeleri Sosyal G\u00fcvenlik Kurumu\u2019nun olay\u0131 i\u015f kazas\u0131 olarak kabul etmesine ba\u011fl\u0131 olacakt\u0131r. \u00d6d\u00fcn\u00e7 alan i\u015fverenin bildirim y\u00fck\u00fcml\u00fcl\u00fcklerine ayk\u0131r\u0131 davranmas\u0131 halinde idari para cezas\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Koruma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn ihlali durumunda \u00f6d\u00fcn\u00e7 i\u015f\u00e7inin haklar\u0131ndan bahsetmek gerekirse;\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u0130lk olarak \u00f6d\u00fcn\u00e7 i\u015f\u00e7i, ciddi ve yak\u0131n bir tehlike durumunda 6331 Say\u0131l\u0131 \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanunu m. 13 uyar\u0131nca \u00f6d\u00fcn\u00e7 alan i\u015fverene kar\u015f\u0131 i\u015f g\u00f6rmekten ka\u00e7\u0131nma hakk\u0131na sahiptir. Ayn\u0131 zamanda \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanunu m.13\/4 \u00f6d\u00fcn\u00e7 i\u015f\u00e7iye gerekli tedbirlerinin al\u0131nmamas\u0131 durumunda i\u015f s\u00f6zle\u015fmesini hakl\u0131 nedenle feshetme hakk\u0131 tan\u0131nm\u0131\u015ft\u0131r. Ancak \u00f6zel istihdam b\u00fcrosunun dahil oldu\u011fu \u00f6d\u00fcn\u00e7 i\u015f ili\u015fkisinde m\u00fcteselsil sorumluluk \u00f6ng\u00f6r\u00fclmedi\u011finden i\u015f\u00e7inin fesih hakk\u0131n\u0131 derhal kullanabilmesi yerine, \u00f6ncelikle \u00f6zel istihdam b\u00fcrosundan \u00f6d\u00fcn\u00e7 i\u015f ili\u015fkisini ortadan kald\u0131rmas\u0131n\u0131 talep etmesi, i\u015fbu talebi kar\u015f\u0131lanmad\u0131\u011f\u0131 takdirde fesih hakk\u0131na sahip olmas\u0131 s\u00f6z konusu olacakt\u0131r.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Meslek edinilmemi\u015f \u00f6d\u00fcn\u00e7 i\u015f ili\u015fkisinde ise, \u00f6d\u00fcn\u00e7 i\u015f\u00e7inin fesih hakk\u0131, i\u015fverenlerin m\u00fcteselsil sorumluluklar\u0131 nedeniyle \u00f6d\u00fcn\u00e7 veren i\u015fverene ba\u015fvuru aranmaks\u0131z\u0131n do\u011facakt\u0131r. Yine meslek edinilmi\u015f \u00f6d\u00fcn\u00e7 i\u015f ili\u015fkisinde \u00f6d\u00fcn\u00e7 i\u015f\u00e7i, i\u015f kazas\u0131 ve meslek hastal\u0131\u011f\u0131na u\u011framas\u0131 durumunda \u00f6d\u00fcn\u00e7 alan i\u015fverenin koruma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc ihlalinden kaynakl\u0131 maddi ve manevi zararlar\u0131n\u0131 yaln\u0131zca \u00f6d\u00fcn\u00e7 alan i\u015fverenden talep edebilecektir. Zira koruma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn ihlali halinde kusur sorumlulu\u011funa gidilebilecektir.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ancak \u00f6zel istihdam b\u00fcrosunun \u00f6d\u00fcn\u00e7 i\u015f\u00e7iye kar\u015f\u0131 hala devam eden sa\u011fl\u0131k g\u00f6zetimi, denetleme ve bilgilendirme gibi y\u00fck\u00fcml\u00fcl\u00fckleri ihlal etmesinin meydana gelen kazada etkisi varsa bu durumda \u00f6zel istihdam b\u00fcrosunun sorumlulu\u011fu da g\u00fcndeme gelecektir. \u00d6d\u00fcn\u00e7 i\u015f\u00e7i, i\u015f kazas\u0131 ve meslek hastal\u0131klar\u0131ndan meydana gelen ve SGK taraf\u0131ndan kar\u015f\u0131lanamayan zararlar\u0131n\u0131 10 y\u0131ll\u0131k genel zamana\u015f\u0131m\u0131na tabi olacak \u015fekilde talep edebilecektir.
