{"id":5107,"date":"2021-04-30T10:43:07","date_gmt":"2021-04-30T10:43:07","guid":{"rendered":"https:\/\/cukurpartners.com\/?p=5107"},"modified":"2021-10-18T14:49:01","modified_gmt":"2021-10-18T14:49:01","slug":"fesih-yasagi-ile-isverence-tek-tarafli-ucretsiz-izin-kullandirma-hakki-30-06-2021-tarihine-kadar-uzatildi","status":"publish","type":"post","link":"https:\/\/old.cukurpartners.com\/tr\/fesih-yasagi-ile-isverence-tek-tarafli-ucretsiz-izin-kullandirma-hakki-30-06-2021-tarihine-kadar-uzatildi\/","title":{"rendered":"Fesih Yasa\u011f\u0131 ile \u0130\u015fverence Tek Tarafl\u0131 \u00dccretsiz \u0130zin Kulland\u0131rma Hakk\u0131 30\/06\/2021 Tarihine Kadar  Uzat\u0131ld\u0131"},"content":{"rendered":"<p>7226 Say\u0131l\u0131 Baz\u0131 Kanunlarda De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun ile 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019na eklenen Ge\u00e7ici 10. madde ile \u0130\u015f Kanunu kapsam\u0131nda olup olmad\u0131\u011f\u0131na bak\u0131lmaks\u0131z\u0131n her t\u00fcrl\u00fc i\u015f veya hizmet s\u00f6zle\u015fmesinin, maddenin y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihinden itibaren 25 inci maddenin birinci f\u0131kras\u0131n\u0131n (II) numaral\u0131 bendinde ve di\u011fer kanunlar\u0131n ilgili h\u00fck\u00fcmlerinde yer alan ahlak ve iyi niyet kurallar\u0131na uymayan haller ve benzeri sebepler d\u0131\u015f\u0131nda \u0130\u015fveren taraf\u0131ndan feshedilemeyece\u011fi d\u00fczenlenmi\u015f, yine kanunun y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihinden itibaren \u00fc\u00e7 ayl\u0131k s\u00fcre i\u00e7inde \u0130\u015fverenin i\u015f\u00e7isini tamamen veya k\u0131smen \u00fccretsiz izne ay\u0131rma hakk\u0131 tan\u0131nm\u0131\u015f, Cumhurba\u015fkanl\u0131\u011f\u0131 kararlar\u0131 ile bu s\u00fcreler iki\u015fer ay uzat\u0131lm\u0131\u015ft\u0131.<\/p>\n<p>30.04.2021 tarihli Resmi Gazete\u2019de yay\u0131nlanan 3930 say\u0131l\u0131 Cumhurba\u015fkan\u0131 Karar\u0131 ile bahse konu s\u00fcrelerin 30\/06\/2021 tarihine kadar uzat\u0131lmas\u0131na karar verilmi\u015ftir.<strong> B\u00f6ylelikle \u0130\u015fverene getirilen fesih yasa\u011f\u0131 ile tek tarafl\u0131 \u00fccretsiz izne \u00e7\u0131karma hakk\u0131 30\/06\/2021 tarihine kadar uzat\u0131lm\u0131\u015f bulunmaktad\u0131r.<\/strong><\/p>\n<p><strong>Prohibition on Termination and the Right of Unilateral Unpaid Leave Period is Extended Until 30.06.2021:<\/strong><\/p>\n<p>With the Law on the Amendments to Certain Laws No. 7226 and temporary Article 10 which has been added to Labor Law No. 4857 , it is regulated that all kind of employment or service contracts, irrespective of whether they are within the scope of the Labor Law or not are prohibited to be terminated by the Employer, except for cases that do not comply with the rules of ethics and bonefide specified in the subparagraph (II) of the first paragraph of Labour Law Article 25 and the relevant provisions of other laws, and similar reasons effective as of the date of the article. Also within three months from the effective date of the law, the Employer has been granted the right to send the employees to wholly or partially unpaid leave, and these periods are extended for two months by these most current Presidental decision. With the Presidential Decision No. 3930 which is published in the Official Gazette dated 30.04.2021, it was decided to extend the said periods for 1 and half more months.
