Maddesinde <\/span><i><span style=\"font-weight: 400;\">\u201cMarka, bir te\u015febb\u00fcs\u00fcn mallar\u0131n\u0131n veya hizmetlerinin di\u011fer te\u015febb\u00fcslerin mallar\u0131ndan veya hizmetlerinden ay\u0131rt edilmesini sa\u011flamas\u0131 ve marka sahibine sa\u011flanan koruman\u0131n konusunun a\u00e7\u0131k ve kesin olarak anla\u015f\u0131lmas\u0131n\u0131 sa\u011flayabilecek \u015fekilde sicilde g\u00f6sterilebilir olmas\u0131 \u015fart\u0131yla ki\u015fi adlar\u0131 d\u00e2hil s\u00f6zc\u00fckler, \u015fekiller, renkler, harfler, say\u0131lar, sesler ve mallar\u0131n veya ambalajlar\u0131n\u0131n bi\u00e7imi olmak \u00fczere her t\u00fcr i\u015faretten olu\u015fabilir.\u201d<\/span><\/i><span style=\"font-weight: 400;\"> ifadesi yer almaktad\u0131r. Bu kapsamda, \u00f6zg\u00fcn ve ay\u0131rt edici \u00f6zelliklere sahip olan \u015fekiller ve tasar\u0131mlar i\u00e7in \u201c\u00fc\u00e7 boyutlu marka\u201d ifadesinin kullan\u0131lmas\u0131 m\u00fcmk\u00fcnd\u00fcr.<\/span><\/p>\n<p><b>\u00dc\u00e7 Boyutlu Marka Kavram\u0131n\u0131n Tescili:<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Kanun a\u00e7\u0131s\u0131ndan bir i\u015faretin marka olarak tescil edilebilmesi i\u00e7in ilk ve en \u00f6nemli unsur i\u015faretin, di\u011fer i\u015faretlerden ay\u0131rt edici niteli\u011fe sahip olmas\u0131d\u0131r. \u0130kinci \u00f6nemli unsur ise i\u015faretin sicilde markaya sahip ki\u015fi nezdinde korundu\u011funun a\u00e7\u0131k ve net olarak anla\u015f\u0131lmas\u0131n\u0131 sa\u011flayabilir olmas\u0131d\u0131r. \u00dc\u00e7 boyutlu markalar i\u00e7in aranan kriterler asl\u0131nda geleneksel markalarda aranan kriterlerle ayn\u0131d\u0131r. Fakat i\u015faretin do\u011fas\u0131 gere\u011fi daha s\u0131k\u0131 bir kontrol sa\u011flanmas\u0131 gerekmektedir. \u00c7\u00fcnk\u00fc \u00fc\u00e7 boyutlu markalar\u0131n do\u011fas\u0131 gere\u011fi sahip oldu\u011fu \u015feklin veya standart ve herkes taraf\u0131ndan bilinebilecek tasar\u0131mlar\u0131n tescile konu edilmesi m\u00fcmk\u00fcn de\u011fildir. \u00d6rne\u011fin, s\u0131radan bir i\u00e7ecek \u015fi\u015fesinin tescili i\u00e7in yap\u0131lm\u0131\u015f olan ba\u015fvuru herhangi bir ayr\u0131c\u0131 nitelik i\u00e7ermemesi ve t\u00fcketici nezdinde herhangi bir i\u00e7ece\u011fi \u00e7a\u011fr\u0131\u015ft\u0131rabilecek nitelikte olmas\u0131 nedeniyle reddedilmi\u015ftir. Bu nedenle, \u00fc\u00e7 boyutlu bir marka tescil ettirilecekken, standart ve ticari hayatta fazlaca kullan\u0131lan \u015fekillerin se\u00e7ilmemesi gerekmektedir.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Bunlar\u0131n d\u0131\u015f\u0131nda ise \u00fc\u00e7 boyutlu markan\u0131n tescil ba\u015fvurusunda a\u015fa\u011f\u0131da yer alan hususlara da dikkat edilmesi gerekmektedir:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Tescil ba\u015fvurusunda a\u00e7\u0131k bir \u015fekilde ba\u015fvurunun niteli\u011finin \u00fc\u00e7 boyutlu marka ba\u015fvurusu oldu\u011funun belirtilmesi,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Tescil edilmek istenen i\u015faretin, tasar\u0131m\u0131n veya ambalaj\u0131n tek bir y\u00f6nden net bir \u015fekilde g\u00f6r\u00fcnd\u00fc\u011f\u00fc marka \u00f6rne\u011finin sisteme y\u00fcklenmesi,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Tescil edilmek istenen i\u015faretin, tasar\u0131m\u0131n veya ambalaj\u0131n marka b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc bozmayacak \u015fekilde maksimum alt\u0131 ayr\u0131 y\u00f6n\u00fcnden g\u00f6r\u00fcn\u00fcm\u00fcn\u00fc i\u00e7eren \u00f6rne\u011finin sisteme y\u00fcklenmesi gerekir.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Kanun\u2019un 5. Maddesi kapsam\u0131nda marka tescil ba\u015fvurular\u0131na ili\u015fkin olarak mutlak ret nedenleri say\u0131lmaktad\u0131r. S\u00f6z konusu bu maddede yer alan d\u00fczenlemelerin \u00fc\u00e7 boyutlu markalar a\u00e7\u0131s\u0131ndan k\u0131saca \u00f6zetlenmesi gerekirse, i\u015faretin, g\u00f6r\u00fcnt\u00fcn\u00fcn veya ambalaj\u0131n \u015fekli;\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Mal\u0131n do\u011fas\u0131ndan kaynaklan\u0131yor,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Mala temel de\u011ferini veriyor veya<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Teknik bir gereklili\u011fin sonucu olarak zorunlu olarak olu\u015fuyor ise;<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">\u0130\u015faretin, tasar\u0131m\u0131n veya ambalaj\u0131n ticaret hayat\u0131nda s\u00fcrekli kullan\u0131lmamas\u0131 halinde bile, ay\u0131rt edici nitelik kazanmas\u0131 m\u00fcmk\u00fcn olmayacakt\u0131r ve ayr\u0131ca \u00fc\u00e7 boyutlu bir marka olarak tescil edilmesi de m\u00fcmk\u00fcn olmayacakt\u0131r.<\/span><\/p>\n<p><b>\u00dc\u00e7 Boyutlu Marka Kavram\u0131n\u0131n Korunmas\u0131:<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Kanun\u2019a g\u00f6re \u00fc\u00e7 boyutlu i\u015faretler tasar\u0131m tescili kapsam\u0131nda tescil edilebilece\u011fi gibi ayn\u0131 zamanda, \u00fc\u00e7 boyutlu marka olarak da tescil edilebilir. Kanuna g\u00f6re, tasar\u0131m tescili yap\u0131lm\u0131\u015f olan i\u015faretler i\u00e7in ba\u015fvuru tarihinden itibaren her 5 y\u0131lda bir yenileme i\u015fleminin yap\u0131lmas\u0131 \u015fart\u0131yla, 25 y\u0131la kadar yasal koruma sa\u011flanmaktad\u0131r.\u00a0 Marka tescili yap\u0131lm\u0131\u015f i\u015faretler i\u00e7in ise, her 10 y\u0131lda bir yenileme i\u015fleminin yap\u0131lmas\u0131 \u015fart\u0131yla sonsuz s\u00fcre yasal koruma sa\u011flanmaktad\u0131r.
