Bu d\u00fczenleme ile birlikte, i\u015fyerinde i\u015fveren taraf\u0131ndan, ayn\u0131 veya benzer ko\u015fullarda bulunan ki\u015filerin ayn\u0131 i\u015fleme tabi tutulmas\u0131 gerekti\u011fi h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015f olup h\u00fckm\u00fcn ihlali halinde yapt\u0131r\u0131mlar \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr.<\/span><\/p>\n<p><b>\u0130\u015fverenin E\u015fit Davranma Borcu Ne Anlama Gelmektedir?<\/b><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">E\u015fit davranma borcu, i\u015fverenin ayn\u0131 veya benzer ko\u015fullar alt\u0131nda \u00e7al\u0131\u015fan i\u015f\u00e7ilerine e\u015fit muamelede bulunmas\u0131 anlam\u0131na gelmektedir. Bir ba\u015fka deyi\u015fle, \u0130\u015f Hukuku bak\u0131m\u0131ndan e\u015fit i\u015flem borcunun i\u015fverenin, i\u015fyerinde \u00e7al\u0131\u015fan i\u015f\u00e7ilere hakl\u0131 ve objektif bir neden olmad\u0131k\u00e7a farkl\u0131 davranmama borcu oldu\u011funu s\u00f6yleyebiliriz. Bu bor\u00e7 \u00e7er\u00e7evesinde i\u015fveren hakl\u0131 ve objektif bir sebebi olmad\u0131k\u00e7a i\u015f\u00e7iye kar\u015f\u0131 keyfi uygulamalarda bulunup ayr\u0131mc\u0131l\u0131k yapamayacakt\u0131r. Bu noktada belirtmek gerekir ki e\u015fit i\u015flem ilkesi mutlak de\u011fil nispi bir niteli\u011fi haizdir. \u0130\u015fverenin farkl\u0131 davranmas\u0131n\u0131 hakl\u0131la\u015ft\u0131ran bir durumun varl\u0131\u011f\u0131 halinde, \u00e7al\u0131\u015fanlar\u0131 aras\u0131nda farkl\u0131 i\u015flem yapmas\u0131 adalet anlay\u0131\u015f\u0131na uygun d\u00fc\u015f\u00fcyorsa e\u015fitlik ilkesine ayk\u0131r\u0131 olarak kabul edilmeyecektir. Ancak i\u015fveren tamamen keyfi ya da k\u00f6t\u00fcniyetli bi\u00e7imde bu hakk\u0131n\u0131 kullanamaz. Burada \u00f6nemli olan nokta, i\u015fverenin hakk\u0131n\u0131 d\u00fcr\u00fcstl\u00fck kurallar\u0131 \u00e7er\u00e7evesinde kullanmas\u0131d\u0131r. E\u015fit davranma borcu sadece i\u015f ili\u015fkisinin devam\u0131 s\u0131ras\u0131nda de\u011fil kurulmas\u0131 ve feshedilmesi s\u0131ras\u0131nda da g\u00fcndeme gelebilecektir.<\/span><b>\u00a0<\/b><\/p>\n<p><b>Borcun kapsam\u0131 nedir?<\/b><\/p>\n<p><span style=\"font-weight: 400;\">E\u015fit davranma borcunun kapsam\u0131 4857 say\u0131l\u0131 \u0130\u015f Kanununun 5. maddesinde \u2018E\u015fit davranma ilkesi\u2019 ba\u015fl\u0131\u011f\u0131 alt\u0131nda belirlenmi\u015ftir. Bu madde ile i\u015f ili\u015fkisinde dil, \u0131rk, renk, cinsiyet, engellilik, siyasal d\u00fc\u015f\u00fcnce, felsef\u00ee inan\u00e7, din ve mezhep ve benzeri sebeplere dayanarak ayr\u0131m yap\u0131lamayaca\u011f\u0131 h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Bununla birlikte cinsiyet nedeniyle d\u00fc\u015f\u00fck bir \u00fccret kararla\u015ft\u0131r\u0131lmas\u0131, hamilelerin \u00e7ok a\u011f\u0131r bir i\u015fte \u00e7al\u0131\u015ft\u0131r\u0131lmamas\u0131 gibi biyolojik veya i\u015fin niteli\u011fine ili\u015fkin sebepler zorunlu k\u0131lmad\u0131k\u00e7a cinsiyet veya gebelik nedeniyle farkl\u0131 i\u015flem yap\u0131lmas\u0131, esasl\u0131 neden olmad\u0131k\u00e7a tam s\u00fcreli \u00e7al\u0131\u015fan i\u015f\u00e7i kar\u015f\u0131s\u0131nda k\u0131sm\u00ee s\u00fcreli \u00e7al\u0131\u015fan i\u015f\u00e7iye, belirsiz s\u00fcreli \u00e7al\u0131\u015fan i\u015f\u00e7i kar\u015f\u0131s\u0131nda belirli s\u00fcreli \u00e7al\u0131\u015fan i\u015f\u00e7iye farkl\u0131 i\u015flem yap\u0131lmas\u0131 bu madde \u00e7er\u00e7evesinde ihlal olarak de\u011ferlendirilmi\u015ftir.<\/span><\/p>\n<p><b>\u00a0\u0130lkenin Uygulanabilmesi \u0130\u00e7in Gerekli Ko\u015fullar Nelerdir?<\/b><\/p>\n<p><span style=\"font-weight: 400;\">-En az iki i\u015f\u00e7inin varl\u0131\u011f\u0131<\/span><\/p>\n<p><span style=\"font-weight: 400;\">-\u0130\u015f\u00e7ilerin ayn\u0131 i\u015fyerinde \u00e7al\u0131\u015f\u0131yor olmas\u0131<\/span><\/p>\n<p><span style=\"font-weight: 400;\">-Ayn\u0131 i\u015fyerinde \u00e7al\u0131\u015fan t\u00fcm i\u015f\u00e7ileri ilgilendiren bir uygulaman\u0131n varl\u0131\u011f\u0131<\/span><\/p>\n<p><span style=\"font-weight: 400;\">-Borca konu olu\u015fturacak davran\u0131\u015flar\u0131n yak\u0131n zaman aral\u0131klar\u0131nda ger\u00e7ekle\u015ftirilmesi<\/span><\/p>\n<p><b>E\u015fit Davranma Borcuna Ayk\u0131r\u0131l\u0131\u011fa \u00d6rnekler:<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Ayn\u0131 ko\u015ful ve ayn\u0131 verimde \u00e7al\u0131\u015fan i\u015f\u00e7ilerden ortada objektif olarak bir ayr\u0131m yap\u0131lmas\u0131n\u0131n gerektiren bir durum mevcut bulunmaks\u0131z\u0131n;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">&#8211; Fesih nedeni olarak de\u011ferlendirilebilecek bir davran\u0131\u015fta bulunan bir k\u0131s\u0131m i\u015f\u00e7inin i\u015f akdi feshedilmezken bir k\u0131sm\u0131n\u0131n i\u015f akdinin ise bu davran\u0131\u015f nedeniyle sonland\u0131r\u0131lmas\u0131<\/span><\/p>\n<p><span style=\"font-weight: 400;\">&#8211; Bir k\u0131s\u0131m i\u015f\u00e7iye fazla mesai yapt\u0131r\u0131l\u0131p di\u011ferlerine hi\u00e7 yapt\u0131r\u0131lmamas\u0131<\/span><\/p>\n<p><span style=\"font-weight: 400;\">&#8211; \u0130\u015f\u00e7inin sadece cinsel y\u00f6nelimi sebebiyle i\u015fe kabul edilmemesi<\/span><\/p>\n<p><span style=\"font-weight: 400;\">&#8211; \u0130\u015f\u00e7inin i\u015fverenin mensup oldu\u011fu etnik grup ya da dine mensup olmamas\u0131 sebebi ile terfi ettirilmemesi vb.<\/span><\/p>\n<p><b>Ayk\u0131r\u0131l\u0131\u011f\u0131n Sonu\u00e7lar\u0131 Nelerdir?\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">\u0130\u015fverenin e\u015fit i\u015flem borcuna ayk\u0131r\u0131 davranmas\u0131n\u0131n yapt\u0131r\u0131m\u0131 olarak, \u0130\u015f Kanunu\u2019nun 5. maddesinin 6. f\u0131kras\u0131nda \u201cAyr\u0131mc\u0131l\u0131k Tazminat\u0131\u201d d\u00fczenlenmi\u015ftir. \u0130\u015f ili\u015fkisinde veya sona ermesinde i\u015fverenin e\u015fit davranma borcuna ayk\u0131r\u0131 davranmas\u0131 halinde i\u015f\u00e7i 4 aya kadar olan \u00fccret tutar\u0131n\u0131 ve yoksun kald\u0131\u011f\u0131 haklar\u0131 talep edebilecektir. \u0130\u015f\u00e7inin ayr\u0131mc\u0131l\u0131k tazminat\u0131 talep edebilmesi i\u00e7in bir ihlal olu\u015fmu\u015f olmas\u0131 yeterli olup i\u015f\u00e7inin bu durumdan dolay\u0131 ayr\u0131ca zarar g\u00f6rm\u00fc\u015f olmas\u0131 aranmamaktad\u0131r. Ayr\u0131mc\u0131l\u0131k tazminat\u0131 ile birlikte ilke ve y\u00fck\u00fcml\u00fcl\u00fcklere ayk\u0131r\u0131 davranan i\u015fveren veya i\u015fveren vekiline ayr\u0131mc\u0131l\u0131k yap\u0131lan her i\u015f\u00e7i i\u00e7in idari para cezas\u0131 verilebilece\u011fi h\u00fck\u00fcm alt\u0131na al\u0131nmakla birlikte T\u00fcrk Ceza Kanunu\u2019nda ayr\u0131mc\u0131l\u0131k nedeniyle ki\u015finin i\u015fe al\u0131nmas\u0131n\u0131n engellenmesi su\u00e7 olarak d\u00fczenlenmi\u015f ve hapis cezas\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Bu sonu\u00e7lara ek olarak i\u015f\u00e7i, i\u015fverenin borcu ihlal etmesi sonucunda i\u015f s\u00f6zle\u015fmesini hakl\u0131 nedenlerle feshedebilecek, dolay\u0131s\u0131yla ihbar s\u00fcrelerine uymas\u0131 da gerekmeyecektir.<\/span><\/p>\n<p><b>\u0130spat Y\u00fck\u00fc Hangi Taraftad\u0131r?<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Ayr\u0131mc\u0131l\u0131k tazminat\u0131nda ispat y\u00fck\u00fc i\u015f\u00e7idedir. Ancak iki halde ispat y\u00fck\u00fc yer de\u011fi\u015ftirecektir. Bu hallerden ilki i\u015fverenin i\u015f akdini sonland\u0131rmas\u0131 \u00fczerine i\u015f\u00e7inin itiraz etmesidir. \u0130\u015f akdinin, i\u015fverenin e\u015fit i\u015flem ilkesine ayk\u0131r\u0131l\u0131\u011f\u0131 sebebi ile son buldu\u011funu d\u00fc\u015f\u00fcnen i\u015f\u00e7inin itirazda bulunmas\u0131 \u00fczerine feshin ge\u00e7erli nedene dayand\u0131\u011f\u0131n\u0131 ispat y\u00fck\u00fc i\u015fverene aittir. \u0130kinci hal ise i\u015f\u00e7inin, i\u015fverenin e\u015fit davranma borcunu ihlal etti\u011fine dair g\u00fc\u00e7l\u00fc bir emare ortaya koymas\u0131d\u0131r.
