Mevzuat h\u00fck\u00fcmlerine ayk\u0131r\u0131 olarak vardiyal\u0131 \u00e7al\u0131\u015fma yap\u0131lan i\u015f yerlerinde i\u015f\u00e7ilerin i\u015f yerinde \u00e7al\u0131\u015fma \u015fartlar\u0131n\u0131n uygulanmamas\u0131 sebebiyle i\u015f s\u00f6zle\u015fmelerini hakl\u0131 sebeple fesih haklar\u0131 do\u011fmakla birlikte i\u015fverenlere idari para cezas\u0131 uygulanmas\u0131 s\u00f6z konusudur.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun (\u201cKanun\u201d) 69. maddesine g\u00f6re \u00e7al\u0131\u015fma hayat\u0131nda \u201cgece\u201d en ge\u00e7 saat 20:00\u2019de ba\u015flayan en erken saat 06:00\u2019ya kadar ge\u00e7en ve her halde en fazla 11 saat s\u00fcren g\u00fcn d\u00f6nemdir. \u0130\u015fbu h\u00fck\u00fcm kamu d\u00fczenine ili\u015fkin olmas\u0131 nedeniyle i\u015f\u00e7i aleyhine de\u011fi\u015ftirilemez. \u0130\u015f\u00e7i k\u0131smen g\u00fcnd\u00fcz, k\u0131smen de gece d\u00f6nemine giren saatler aras\u0131nda \u00e7al\u0131\u015ft\u0131r\u0131lmakta ise bu \u00e7al\u0131\u015fman\u0131n hangi d\u00f6nemden say\u0131laca\u011f\u0131 \u201cPostalar Halinde \u0130\u015f\u00e7i \u00c7al\u0131\u015ft\u0131r\u0131larak Y\u00fcr\u00fct\u00fclen \u0130\u015flerde \u00c7al\u0131\u015fmalara \u0130li\u015fkin \u00d6zel Usul ve Esaslar Hakk\u0131nda Y\u00f6netmelik\u201d te (\u201cY\u00f6netmelik\u201d) a\u00e7\u0131klanm\u0131\u015ft\u0131r. Buna g\u00f6re \u00e7al\u0131\u015fma s\u00fcresinin yar\u0131s\u0131ndan \u00e7o\u011fu gece d\u00f6nemine rastlayan bir postan\u0131n \u00e7al\u0131\u015fmas\u0131, gece \u00e7al\u0131\u015fmas\u0131 say\u0131l\u0131r. Hem gece hem de g\u00fcnd\u00fcze rastlayan \u00e7al\u0131\u015fma saatlerinin e\u015fit olmas\u0131 halinde i\u015f\u00e7i lehine yorum ilkesi gere\u011fi i\u015fin gece i\u015fi oldu\u011fu kabul edilmelidir.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Gece \u00e7al\u0131\u015fmas\u0131n\u0131n i\u015f\u00e7ilerin sa\u011fl\u0131\u011f\u0131 \u00fczerindeki olumsuz etkileri sebebiyle gece \u00e7al\u0131\u015fmas\u0131 postalar\u0131n\u0131n g\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcresi s\u0131n\u0131rland\u0131r\u0131lm\u0131\u015f olup, i\u015f\u00e7iler gece postalar\u0131nda 7,5 saatten fazla \u00e7al\u0131\u015ft\u0131r\u0131lamaz. (\u0130\u015f Kanunu m. 69 f.3) Her ne kadar \u0130\u015f Kanunu kural olarak gece postalar\u0131nda 7,5 saatten fazla \u00e7al\u0131\u015fmay\u0131 yasaklam\u0131\u015f olsa da \u00f6zel g\u00fcvenlik hizmetleri, sa\u011fl\u0131k hizmetleri ve turizm hizmetlerinde i\u015f\u00e7inin yaz\u0131l\u0131 onay\u0131 al\u0131narak 7,5 saatin \u00fczerinde gece \u00e7al\u0131\u015fmas\u0131 yapt\u0131r\u0131labilir. Ayn\u0131 \u015fekilde \u0130\u015f Kanunu\u2019nun 42. Maddesi kapsam\u0131nda i\u015fyerinde fazla \u00e7al\u0131\u015fmay\u0131 gerektiren zorunlu sebeplerin do\u011fmas\u0131 ve \u0130\u015f Kanunu\u2019nun 43. Maddesi kapsam\u0131nda ola\u011fan\u00fcst\u00fc hallerin varl\u0131\u011f\u0131 durumlar\u0131nda s\u00f6z konusu 7,5 saatlik s\u0131n\u0131r\u0131n a\u015f\u0131lmas\u0131 m\u00fcmk\u00fcnd\u00fcr. Yarg\u0131tay gece \u00e7al\u0131\u015fmalar\u0131nda 7,5 saatten fazla olan \u00e7al\u0131\u015fmay\u0131 fazla mesai olarak kabul etmi\u015f haftal\u0131k yasal \u00e7al\u0131\u015fma s\u0131n\u0131r\u0131 olan 45 g\u00fcn\u00fcn a\u015f\u0131lmamas\u0131 s\u00f6z konusu olsa bile 7,5 saatin \u00fczerinde olan gece \u00e7al\u0131\u015fmas\u0131n\u0131 a\u015fan s\u00fcre i\u00e7in fazla \u00e7al\u0131\u015fma \u00fccreti \u00f6denmesi gerekti\u011fini belirtmi\u015ftir.1\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u0130\u015f Kanunu ve ilgili mevzuat h\u00fck\u00fcmleri uyar\u0131nca i\u015fyerinde vardiyal\u0131 \u00e7al\u0131\u015fma yap\u0131lmas\u0131 i\u00e7in i\u015f\u00e7inin onay\u0131 aranmamaktad\u0131r. Ancak bu durum i\u015f yerinde vardiyal\u0131 \u00e7al\u0131\u015fma yap\u0131ld\u0131\u011f\u0131n\u0131 bilen ve i\u015f s\u00f6zle\u015fmesinde bu hususta h\u00fck\u00fcm bulunan i\u015f\u00e7iler y\u00f6n\u00fcnden ge\u00e7erlidir. Aksi takdirde i\u015f\u00e7ilerin gece vardiyas\u0131nda \u00e7al\u0131\u015ft\u0131r\u0131lmak istenmeleri, i\u015f s\u00f6zle\u015fmelerini aleyhlerine de\u011fi\u015ftiren bir durum olmas\u0131 nedeniyle \u00e7al\u0131\u015fma ko\u015fullar\u0131nda esasl\u0131 de\u011fi\u015fiklik olarak kabul edilir. (\u0130\u015f Kanunu md.22) Bu durumda i\u015f\u00e7iye s\u00f6z konusu de\u011fi\u015fiklik teklifi yaz\u0131l\u0131 \u015fekilde yap\u0131lmal\u0131 ve i\u015f\u00e7inin alt\u0131 i\u015f g\u00fcn\u00fc i\u00e7inde s\u00f6z konusu de\u011fi\u015fikli\u011fe yaz\u0131l\u0131 onay\u0131 al\u0131nmal\u0131d\u0131r. De\u011fi\u015fikli\u011fe onay vermeyen i\u015f\u00e7inin gece vardiyas\u0131nda \u00e7al\u0131\u015ft\u0131r\u0131lmaya zorlanmas\u0131 halinde i\u015f s\u00f6zle\u015fmesini hakl\u0131 nedenle fesih hakk\u0131 do\u011fmakla birlikte somut olay\u0131n \u00f6zelli\u011fine g\u00f6re bu durum i\u015fverenin haks\u0131z feshi olarak de\u011ferlendirilebilir.2 Gece \u00e7al\u0131\u015fmas\u0131 nedeniyle sa\u011fl\u0131\u011f\u0131n\u0131n bozuldu\u011funu raporla belgeleyen i\u015f\u00e7iye i\u015fveren, olanaklar\u0131n elverdi\u011fi \u00f6l\u00e7\u00fcde g\u00fcnd\u00fcz postas\u0131nda durumuna uygun bir i\u015f verir.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Y\u00f6netmeli\u011fin 4. Maddesi uyar\u0131nca nitelikleri dolay\u0131s\u0131yla s\u00fcrekli \u00e7al\u0131\u015ft\u0131klar\u0131 i\u00e7in durmaks\u0131z\u0131n birbiri ard\u0131na postalar halinde i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131r\u0131larak y\u00fcr\u00fct\u00fclen i\u015flerde posta say\u0131s\u0131 24 saatlik s\u00fcre i\u00e7inde en az \u00fc\u00e7 i\u015f\u00e7i postas\u0131 \u00e7al\u0131\u015ft\u0131r\u0131lacak \u015fekilde d\u00fczenlenir. Gece ve g\u00fcnd\u00fcz i\u015fletilen ve n\u00f6betle\u015fe i\u015f\u00e7i postalar\u0131 \u00e7al\u0131\u015ft\u0131r\u0131larak y\u00fcr\u00fct\u00fclen i\u015flerde postalar; en fazla bir i\u015f haftas\u0131 gece \u00e7al\u0131\u015ft\u0131r\u0131lan i\u015f\u00e7ilerin, ondan sonra gelen ikinci i\u015f haftas\u0131nda g\u00fcnd\u00fcz \u00e7al\u0131\u015ft\u0131r\u0131lmalar\u0131 suretiyle ve postalar birbirlerinin yerini alacak \u015fekilde d\u00fczenlenir. \u0130\u015fin niteli\u011fi ve y\u00fcr\u00fct\u00fcm\u00fc, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi g\u00f6z \u00f6n\u00fcnde tutularak, gece ve g\u00fcnd\u00fcz postalar\u0131nda iki haftal\u0131k n\u00f6betle\u015fme esas\u0131 da uygulanabilir. Posta de\u011fi\u015fiminde i\u015f\u00e7iler s\u00fcrekli olarak en az on bir saat dinlendirilmeden \u00e7al\u0131\u015ft\u0131r\u0131lamaz. \u0130\u015f\u00e7ilerin vardiyalar\u0131n\u0131n haftada bir ve en ge\u00e7 haftada iki de\u011fi\u015ftirilmesi zorunlu olup, Yarg\u0131tay\u2019\u0131n i\u015f\u00e7inin s\u00fcrekli gece vardiyas\u0131nda \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131n\u0131n i\u015f\u00e7i a\u00e7\u0131s\u0131ndan hakl\u0131 sebeple fesih nedeni oldu\u011funa ili\u015fkin kararlar\u0131 bulunmaktad\u0131r.3<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ayr\u0131ca i\u015fveren veya i\u015fveren vekilleri posta say\u0131s\u0131 ile her postan\u0131n i\u015fe ba\u015flama ve bitirme saatlerini, postalar halinde \u00e7al\u0131\u015ft\u0131rd\u0131klar\u0131 i\u015f\u00e7ilerin ad ve soyadlar\u0131n\u0131, ara dinlenmelerini, hafta tatillerini ve bunlara ili\u015fkin de\u011fi\u015fiklikleri d\u00fczenleyerek i\u015fyerinde i\u015f\u00e7ilerin kolayca g\u00f6r\u00fcp okuyabilecekleri \u015fekilde ilan etmekle y\u00fck\u00fcml\u00fcd\u00fcr. Ayn\u0131 \u015fekilde vardiyal\u0131 \u00e7al\u0131\u015fma yap\u0131lan i\u015flerde i\u015fveren veya i\u015fveren vekili, her vardiyada \u00e7al\u0131\u015fan i\u015f\u00e7ilerin ad ve soyadlar\u0131n\u0131 i\u00e7eren listeleri, i\u015fyerinde bulundurmalar\u0131 gerekmektedir.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Yukar\u0131da a\u00e7\u0131klad\u0131\u011f\u0131m\u0131z postalar halinde \u00e7al\u0131\u015fma kurallar\u0131na uyulmamas\u0131 halinde i\u015fyerinde \u00e7al\u0131\u015fma \u015fartlar\u0131 uygulanmam\u0131\u015f say\u0131lacakt\u0131r. Bu durumda i\u015f\u00e7inin i\u015f s\u00f6zle\u015fmesini hakl\u0131 nedenle fesih hakk\u0131 do\u011far.
