Normal \u015fartlar alt\u0131nda bir i\u015f s\u00f6zle\u015fmesi iki tarafa da kar\u015f\u0131l\u0131kl\u0131 bor\u00e7 y\u00fckler. \u0130\u015f\u00e7inin s\u00f6zle\u015fmeden do\u011fan borcu, edimini yerine getirmekle m\u00fckellef oldu\u011fu i\u015fi yapmakt\u0131r. \u0130\u015fverenin s\u00f6zle\u015fmeden do\u011fan borcu ise, i\u015f\u00e7i taraf\u0131ndan yerine getirilen i\u015fe kar\u015f\u0131l\u0131k \u00fccret \u00f6deme borcudur: Taraflardan birisi borcunu yerine getirmedi\u011fi halde, di\u011fer taraf\u0131n ifadan ka\u00e7\u0131nma, tazminat isteme veya s\u00f6zle\u015fmeden d\u00f6nme gibi birtak\u0131m haklar\u0131 kanun taraf\u0131ndan kendilerine tan\u0131nm\u0131\u015ft\u0131r. Ancak i\u015f s\u00f6zle\u015fmesinin ask\u0131ya al\u0131nmas\u0131 halinde taraflar\u0131n birbirine kar\u015f\u0131 bor\u00e7lar\u0131 devam etmemektedir. \u0130\u015f\u00e7i bu s\u00fcre i\u00e7erisinde i\u015f g\u00f6rme edimini ifa etmez, i\u015fveren ise baz\u0131 haller sakl\u0131 kalmak \u015fart\u0131yla \u00fccret \u00f6demez.<\/i><\/b><\/p>\n<p><span style=\"font-weight: 400;\">\u0130\u015f\u00e7inin i\u015f akdinin ask\u0131ya al\u0131nmas\u0131n\u0131n ko\u015fullar\u0131; ifa imk\u00e2ns\u0131zl\u0131\u011f\u0131 ve ask\u0131 halinin ge\u00e7ici olmas\u0131, kusursuz olmas\u0131 ve esasl\u0131 olmamas\u0131d\u0131r. Yasada d\u00fczenlenen baz\u0131 ask\u0131ya al\u0131nma halleri \u015funlard\u0131r;<\/span><\/p>\n<p><b><i>\u0130\u015f\u00e7inin G\u00f6zalt\u0131 veya Tutukluluk Hali:<\/i><\/b> <span style=\"font-weight: 400;\">\u0130\u015f Kanunda say\u0131lan bu halin ger\u00e7ekle\u015fmesi durumunda i\u015fveren \u0130\u015f Kanunu madde 17\u2019de belirtilen bildirim s\u00fcresine uyarak i\u015f akdine son verebilmektedir. \u0130\u015f Kanunu madde 17\u2019de say\u0131lan s\u00fcre ve sonras\u0131nda i\u015f akdi i\u015fverence feshedilmezse i\u015f s\u00f6zle\u015fmesinin ask\u0131ya al\u0131nmas\u0131 ger\u00e7ekle\u015fir.<\/span><\/p>\n<p><b><i>Ekonomik Kriz:<\/i><\/b> <span style=\"font-weight: 400;\">\u0130\u015fsizlik Sigortas\u0131 kanunu ek madde 2\u2019de belirtilen h\u00fckme g\u00f6re, b\u00f6lgesel veya sekt\u00f6rel ekonomik krizin varl\u0131\u011f\u0131 halinde bu s\u00fcrede \u00e7al\u0131\u015ft\u0131r\u0131lamayan i\u015f\u00e7ilerin s\u00f6zle\u015fmeleri ask\u0131da oldu\u011fu kabul edilmi\u015ftir.<\/span><\/p>\n<p><b><i>\u0130\u015f\u00e7inin Hastal\u0131k, Kaza, Do\u011fum ve Gebeli\u011fi:<\/i><\/b> <span style=\"font-weight: 400;\">\u0130\u015f\u00e7inin kendi kast\u0131 d\u0131\u015f\u0131nda ger\u00e7ekle\u015fen hastal\u0131k, kaza, do\u011fum ve gebelik gibi hallerin varl\u0131\u011f\u0131, i\u015fverene i\u015f s\u00f6zle\u015fmesini bildirimsiz fesih hakk\u0131 vermektedir. Bu hak \u0130\u015f Kanunu madde 25\/I\u2019 de say\u0131lm\u0131\u015ft\u0131r. \u0130\u015fverenin fesih hakk\u0131 \u0130\u015f Kanunu madde 17\u2019de say\u0131lan bildirim s\u00fcresinin a\u015f\u0131lmas\u0131 halinde m\u00fcmk\u00fcnd\u00fcr. Bu s\u00fcre i\u00e7erisinde ve i\u015f s\u00f6zle\u015fmesi feshedilmedi\u011fi takdirde i\u015f\u00e7inin s\u00f6zle\u015fmesi ask\u0131dad\u0131r.<\/span><\/p>\n<p><b><i>Grev ve Lokavt S\u00fcreci:<\/i><\/b> <span style=\"font-weight: 400;\">Sendikalar Ve Toplu \u0130\u015f S\u00f6zle\u015fmesi Kanunu madde 67\/1\u2019de \u201cKanuni greve kat\u0131lan, greve kat\u0131lmayan veya kat\u0131lmaktan vazge\u00e7ip de grev nedeniyle \u00e7al\u0131\u015ft\u0131r\u0131lamayan ve kanuni lokavta maruz kalan i\u015f\u00e7ilerin i\u015f s\u00f6zle\u015fmeleri grev ve lokavt s\u00fcresince ask\u0131da kal\u0131r.\u201d Denilmi\u015ftir. Kanun maddesi uyar\u0131nca lokavt ve grev halinde i\u015f s\u00f6zle\u015fmesinin ask\u0131ya al\u0131nmas\u0131 ger\u00e7ekle\u015fecektir.<\/span><\/p>\n<p><b><i>\u0130\u015f\u00e7inin Y\u00f6netici Olmas\u0131 Hali:<\/i><\/b> <span style=\"font-weight: 400;\">Sendikalar Ve Toplu \u0130\u015f S\u00f6zle\u015fmesi Kanunu madde 23\/1\u2019de i\u015f\u00e7inin i\u015f kurulu\u015funda y\u00f6netici olmak i\u00e7in i\u015fyerinden ayr\u0131lmas\u0131 durumunda, i\u015f s\u00f6zle\u015fmesinin ask\u0131ya al\u0131nmas\u0131 halinin olaca\u011f\u0131 belirtilmi\u015ftir.<\/span><\/p>\n<p><b><i>Askerlik Hali:<\/i><\/b> <span style=\"font-weight: 400;\">En az 1 y\u0131l ayn\u0131 i\u015fyerinde \u00e7al\u0131\u015fan i\u015f\u00e7inin, muvazzaf askerlik d\u0131\u015f\u0131ndaki manevra veya herhangi bir sebeple silah alt\u0131na al\u0131nan veya herhangi bir kanundan do\u011fan \u00e7al\u0131\u015fma \u00f6devi y\u00fcz\u00fcnden i\u015finden ayr\u0131lan i\u015f\u00e7inin i\u015f s\u00f6zle\u015fmesi feshedilmi\u015f say\u0131l\u0131r. \u0130\u015f s\u00f6zle\u015fmesinin feshedilmi\u015f say\u0131labilmesi i\u00e7in i\u015f\u00e7inin, en az 1 y\u0131ld\u0131r \u00e7al\u0131\u015f\u0131yor olmas\u0131 ve i\u015finden ayr\u0131ld\u0131\u011f\u0131 g\u00fcnden itibaren 2 ay ge\u00e7mi\u015f olmas\u0131 gerekmektedir. \u0130\u015f Kanunu madde 31\u2019de belirtilen bu 2 ayl\u0131k s\u00fcre i\u00e7erisinde i\u015f s\u00f6zle\u015fmesinin ask\u0131ya al\u0131nmas\u0131 g\u00fcndeme gelecektir.<\/span><\/p>\n<p><b><i>Zorlay\u0131c\u0131 Sebepler:<\/i><\/b> <span style=\"font-weight: 400;\">\u0130\u015f Kanunu madde 24\/ III\u2019 de i\u015f yerinin 1 haftadan fazla s\u00fcre ile durmas\u0131n\u0131 gerektiren zorlay\u0131c\u0131 sebep bulunmas\u0131 halinde, i\u015f s\u00f6zle\u015fmesinin hakl\u0131 nedenle i\u015f\u00e7i taraf\u0131ndan feshedilebilece\u011fi belirtilmi\u015ftir. Kanunda belirtilen bu zorlay\u0131c\u0131 sebep devam ederken ge\u00e7en s\u00fcrede veya sonras\u0131nda i\u015f\u00e7inin s\u00f6zle\u015fmeyi feshetmemesi halinde i\u015f s\u00f6zle\u015fmesi ask\u0131da olacakt\u0131r. Zorlay\u0131c\u0131 sebeplerin ne oldu\u011fu merak edilirse, bunlara \u00f6rnek olarak i\u015f yerinde meydana gelen yang\u0131n, deprem gibi do\u011fal afetler say\u0131labilir. Zorlay\u0131c\u0131 sebep sadece i\u015fyerine \u00f6zg\u00fc de\u011fildir. Ayr\u0131ca \u0130\u015f Kanunu madde 25\/ III\u2019 de belirtildi\u011fine g\u00f6re, i\u015f\u00e7inin 1 haftadan fazla \u00e7al\u0131\u015fmaktan al\u0131koyan sebeplerde zorlay\u0131c\u0131 sebep olarak kabul edilmi\u015ftir. Ayr\u0131ca bu s\u00fcre zarf\u0131nda i\u015f s\u00f6zle\u015fmesinin ask\u0131ya al\u0131nmas\u0131 hali uygulama alan\u0131 bulur.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u0130\u015f s\u00f6zle\u015fmesinin ask\u0131ya al\u0131nmas\u0131 durumunda, i\u015f akdi ge\u00e7ici olarak h\u00fck\u00fcm ifade etmemektedir. Ask\u0131 s\u00fcrecinin sona ermesinden sonra, ask\u0131 s\u00fcrecinden \u00f6nceki d\u00f6nemde oldu\u011fu gibi bor\u00e7lar devam eder. Ask\u0131 halinde i\u015f\u00e7inin i\u015f g\u00f6rme borcu ask\u0131da kal\u0131r, ancak i\u015fverenin \u00fccret \u00f6deme borcu baz\u0131 hallerde sakl\u0131d\u0131r. \u0130\u015fverenin ask\u0131 halinde dahi \u00f6demesi \u00f6ng\u00f6r\u00fclen \u00fccretler \u0130\u015f Kanunu\u2019nun 40.Maddesinde h\u00fckmedilmi\u015ftir. Kanun uyar\u0131nca zorlay\u0131c\u0131 sebebin varl\u0131\u011f\u0131nda ve ask\u0131 s\u00fcresinde, 1 haftal\u0131k \u00fccretin yar\u0131m \u00fccret olarak i\u015f\u00e7iye \u00f6denece\u011fi belirtilmi\u015ftir. \u0130\u015f s\u00f6zle\u015fmesinin ask\u0131ya al\u0131nmas\u0131n\u0131n k\u0131dem tazminat\u0131 y\u00f6n\u00fcnden etkisi de b\u00fcy\u00fck \u00f6nem arz etmektedir.
