Bu d\u00fczenlemeye g\u00f6re kira art\u0131\u015f oran\u0131 \u201cTaraflar\u0131n yenilenen kira d\u00f6nemlerinde uygulanacak kira bedeline ili\u015fkin anla\u015fmalar\u0131, bir \u00f6nceki kira y\u0131l\u0131nda t\u00fcketici fiyat endeksindeki oniki ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131n\u0131 ge\u00e7memek ko\u015fuluyla ge\u00e7erlidir.\u201d H\u00fckm\u00fcne g\u00f6re belirlenmektedir. Kira art\u0131\u015f oran\u0131, her ay\u0131n ba\u015f\u0131nda T\u00dc\u0130K (T\u00fcrkiye \u0130statistik Kurumu) taraf\u0131ndan a\u00e7\u0131klan\u0131r. Yenilenen kira y\u0131l\u0131ndaki art\u0131\u015f da bu oran dikkate al\u0131narak ger\u00e7ekle\u015ftirilir.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00dclkemizin i\u00e7inde bulundu\u011fu ekonomik durum ve enflasyonist ortam, kira art\u0131\u015f oranlar\u0131n\u0131n olduk\u00e7a y\u00fcksek \u00e7\u0131kmas\u0131na sebep olmaktad\u0131r. Bu durum da \u00f6zellikle kirac\u0131lar\u0131 zorlamakta ve kiraya verenlerin de \u00f6denmeyen kira bedelleri sebebiyle kirac\u0131lar\u0131 tahliye etme yoluna gitmelerine neden olmaktad\u0131r. Bunun \u00f6n\u00fcne ge\u00e7ebilmek i\u00e7in, Kanun Koyucu, kira art\u0131\u015f oranlar\u0131 ile ilgili yeni bir d\u00fczenleme getirmi\u015ftir. 7409 say\u0131l\u0131 Avukatl\u0131k Kanunu ile T\u00fcrk Bor\u00e7lar Kanununda De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun\u2019un 4. Maddesi \u015fu \u015fekilde d\u00fczenlenmi\u015ftir;<\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">11\/1\/2011\u00a0tarihli ve 6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanununa a\u015fa\u011f\u0131daki ge\u00e7ici madde eklenmi\u015ftir.<\/span><\/i><\/p>\n<p><i><span style=\"font-weight: 400;\">\u201cGE\u00c7\u0130C\u0130 MADDE 1- Konut kiralar\u0131 bak\u0131m\u0131ndan bu maddenin y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarih il\u00e2\u00a01\/7\/2023\u00a0(bu tarih d\u00e2hil) tarihleri aras\u0131nda yenilenen kira d\u00f6nemlerinde uygulanacak kira bedeline ili\u015fkin anla\u015fmalar, bir \u00f6nceki kira y\u0131l\u0131na ait kira bedelinin y\u00fczde yirmi be\u015fini ge\u00e7memek ko\u015fuluyla ge\u00e7erlidir. Bir \u00f6nceki kira y\u0131l\u0131n\u0131n t\u00fcketici fiyat endeksindeki\u00a0oniki\u00a0ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131n\u0131n y\u00fczde yirmi be\u015fin alt\u0131nda kalmas\u0131 halinde de\u011fi\u015fim oran\u0131 ge\u00e7erlidir. Bu kural, bir y\u0131ldan daha uzun s\u00fcreli kira s\u00f6zle\u015fmelerinde de uygulan\u0131r. Bu oranlar\u0131 ge\u00e7ecek \u015fekilde yap\u0131lan s\u00f6zle\u015fmeler, fazla miktar y\u00f6n\u00fcnden ge\u00e7ersizdir. Bu f\u0131kra h\u00fckm\u00fc, 344 \u00fcnc\u00fc maddenin ikinci f\u0131kras\u0131 uyar\u0131nca h\u00e2kim taraf\u0131ndan verilecek kararlar bak\u0131m\u0131ndan da uygulan\u0131r.\u201d<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">T\u00fcrk Bor\u00e7lar Kanunu\u2019na eklenen bu madde ile kira art\u0131\u015f oran\u0131, bir \u00f6nceki kira y\u0131l\u0131na ait kira bedelinin y\u00fczde yirmi be\u015fini ge\u00e7memek ko\u015fulu ile ge\u00e7erli hale getirilmi\u015ftir. B\u00f6ylelikle T\u00dc\u0130K taraf\u0131ndan a\u00e7\u0131klanan kira art\u0131\u015f oran\u0131 y\u00fczde yirmi be\u015fin \u00fczerinde olsa dahi, en fazla y\u00fczde yirmi be\u015f oran\u0131nda uygulanabilecektir. Ancak y\u00fczde yirmi be\u015flik s\u0131n\u0131r kat\u2019i olarak uygulanacak bir s\u0131n\u0131r de\u011fildir. Kanun\u2019a g\u00f6re, \u015fayet t\u00fcketici fiyat endeksindeki on iki ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131 y\u00fczde yirmi be\u015fin alt\u0131nda kal\u0131rsa bu de\u011fi\u015fim oran\u0131 uygulanacakt\u0131r. Yani kiraya veren, t\u00fcketici fiyat endeksindeki de\u011fi\u015fim oran\u0131, \u00f6rne\u011fin y\u00fczde on be\u015f olarak a\u00e7\u0131klan\u0131rsa y\u00fczde yirmi be\u015f oran\u0131nda art\u0131\u015f yap\u0131lmas\u0131n\u0131 talep edemeyecektir. Kanun metninde, bu d\u00fczenlemenin konut kiralar\u0131 bak\u0131m\u0131ndan ge\u00e7erli oldu\u011fu h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015f oldu\u011fundan i\u015fyeri kiralar\u0131 bak\u0131m\u0131ndan bu h\u00fckm\u00fcn ge\u00e7erli olmayaca\u011f\u0131n\u0131 ve T\u00dc\u0130K taraf\u0131ndan a\u00e7\u0131klanan oranda kira art\u0131\u015f\u0131 yap\u0131lmas\u0131na devam edilece\u011fini de\u011ferlendirmekteyiz.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">7409 say\u0131l\u0131 Kanun ile T\u00fcrk Bor\u00e7lar Kanunu\u2019na eklenen ek maddeye g\u00f6re, y\u00fczde yirmi be\u015flik art\u0131\u015f oran\u0131 s\u0131n\u0131rlamas\u0131, Kanun\u2019un y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarih ila 1 Temmuz 2023 tarihleri aras\u0131nda yenilenen kira d\u00f6nemlerinde uygulanabilecektir. Kanun\u2019un y\u00fcr\u00fcrl\u00fck tarihi yay\u0131m tarihi olarak belirlenmi\u015f olup Resmi Gazete\u2019de yay\u0131mlanma tarihi 11 Haziran 2022\u2019dir. Buna ba\u011fl\u0131 olarak da 11 Haziran 2022 tarihi ile 1 Temmuz 2023 tarihi aras\u0131nda (bu tarihler dahil olmak \u00fczere) yenilenen kira d\u00f6nemlerinde uygulanacak olan art\u0131\u015f oran\u0131 y\u00fczde yirmi be\u015f ile s\u0131n\u0131rland\u0131r\u0131lm\u0131\u015ft\u0131r. Kanun metninde bir \u00f6nceki kira y\u0131l\u0131na ait kira bedellerine uygulanacak art\u0131\u015f oran\u0131n y\u00fczde yirmi be\u015fi ge\u00e7meyece\u011fi h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015f ve bu h\u00fckm\u00fcn uygulanaca\u011f\u0131 son yenilenme tarihi de 1 Temmuz 2023 olarak belirlenmi\u015f oldu\u011fundan, i\u015fbu madde 1 Temmuz 2022 tarihinden sonra imzalanacak olan kira s\u00f6zle\u015fmelerini etkilemeyecektir.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kanun ile eklenen ge\u00e7ici maddenin devam\u0131nda ise, \u201c<\/span><i><span style=\"font-weight: 400;\">Bu f\u0131kra h\u00fckm\u00fc, 344 \u00fcnc\u00fc maddenin ikinci f\u0131kras\u0131 uyar\u0131nca h\u00e2kim taraf\u0131ndan verilecek kararlar bak\u0131m\u0131ndan da uygulan\u0131r. \u201c <\/span><\/i><span style=\"font-weight: 400;\">h\u00fckm\u00fc ile y\u00fczde yirmi be\u015flik s\u0131n\u0131rlaman\u0131n T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 344\/2 maddesine g\u00f6re, taraflarca kira art\u0131\u015f oran\u0131nda bir anla\u015fma yap\u0131lmam\u0131\u015fsa uygulanabilece\u011fi de\u011ferlendirilmektedir. Fakat g\u00fcn\u00fcm\u00fczde neredeyse t\u00fcm kira s\u00f6zle\u015fmelerinde kira art\u0131\u015f oran\u0131 yer ald\u0131\u011f\u0131ndan, ge\u00e7ici maddenin bu h\u00fckm\u00fcn\u00fcn uygulama alan\u0131 bulmas\u0131 olduk\u00e7a zor olacakt\u0131r.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 344\/3 maddesi, be\u015f y\u0131ldan uzun s\u00fcreli veya be\u015f y\u0131ldan sonra yenilenen kira s\u00f6zle\u015fmelerinde, kira tespit davas\u0131 a\u00e7\u0131larak yeni kira bedelinin hakim taraf\u0131ndan belirlenmesini \u00f6n g\u00f6rmektedir. Ancak 7409 say\u0131l\u0131 Kanunla T\u00fcrk Bor\u00e7lar Kanunu\u2019na eklenen ge\u00e7ici maddede, bu h\u00fckme ili\u015fkin bir d\u00fczenleme bulunmamaktad\u0131r. Bu sebeple ge\u00e7ici madde ile getirilen y\u00fczde yirmi be\u015flik s\u0131n\u0131rlaman\u0131n T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 344\/3 maddesi gere\u011fince a\u00e7\u0131lacak olan kira tespit davalar\u0131nda da uygulan\u0131p uygulanmayaca\u011f\u0131 \u015fu an i\u00e7in kesin de\u011fildir. Ge\u00e7ici maddenin lafzi yorumu ile de\u011ferlendirme yapacak olursak, T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 344\/3 maddesi gere\u011fi a\u00e7\u0131lacak olan kira tespit davalar\u0131nda bu s\u0131n\u0131rlaman\u0131n uygulanmayaca\u011f\u0131n\u0131 ve hakimin emsal kira bedelleri ve piyasa ko\u015fullar\u0131n\u0131 g\u00f6z \u00f6n\u00fcne alarak yeni kira bedelini tespit edebilece\u011fi s\u00f6ylenebilir. Ancak uygulamada kira tespit davalar\u0131 bak\u0131m\u0131ndan ge\u00e7ici madde h\u00fckm\u00fcn\u00fcn k\u0131yas yolu ile uygulan\u0131p uygulanmayaca\u011f\u0131n\u0131 ilerleyen g\u00fcnlerde \u00e7\u0131kabilecek olan kararlarda g\u00f6rmemiz m\u00fcmk\u00fcn olacakt\u0131r.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Sonu\u00e7 olarak, 7409 say\u0131l\u0131 Kanun ile T\u00fcrk Bor\u00e7lar Kanunu\u2019na eklenen ge\u00e7ici madde, k\u0131sa vadede kirac\u0131y\u0131 enflasyondan korumak i\u00e7in ihdas edilmi\u015f bir h\u00fck\u00fcm olmakla birlikte, uygulamaya nas\u0131l yans\u0131yaca\u011f\u0131 ilerleyen g\u00fcnlerde netle\u015fecektir.\u00a0<\/span><\/p>\n<p><strong>Avukat \u015eeref \u015een<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda kira art\u0131\u015f oran\u0131, T\u00fcrk Bor\u00e7lar Kanunu\u2019nunda d\u00fczenlenmi\u015ftir.
