U\u0130GK\u2019 nin y\u00fcr\u00fcrl\u00fc\u011fe giri\u015fi; \u015f\u00fcphesiz ki; kanunun pratik hayata yans\u0131malar\u0131 ve izlenecek usuller y\u00f6n\u00fcnden bir uygulama y\u00f6netmeli\u011finin varl\u0131\u011f\u0131n\u0131 gerektirmi\u015ftir.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Yeni bir uygulama y\u00f6netmeli\u011fine olan ihtiya\u00e7 31738 say\u0131l\u0131 ve 2 \u015eubat 2022 tarihli Resmi Gazete\u2019 de yay\u0131mlanan \u201cUluslararas\u0131 \u0130\u015f G\u00fcc\u00fc Kanunu Uygulama Y\u00f6netmeli\u011fi\u201d ile giderilmi\u015ftir. Nitekim ilgili Y\u00f6netmelik U\u0130GK\u2019 nin 25.maddesinde belirtilen hususlar\u0131 ayr\u0131nt\u0131l\u0131 bir \u015fekilde ele almaktad\u0131r.\u00a0<\/span><\/p>\n<p><b>\u201cUluslararas\u0131 \u0130\u015f G\u00fcc\u00fc Politikas\u0131\u201d n\u0131n Y\u00f6netmelik\u2019e Yans\u0131malar\u0131:\u00a0\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">U\u0130GK\u2019 nin \u0130kinci B\u00f6l\u00fcm\u00fc\u2019nde yer verilen \u201cUluslararas\u0131 \u0130\u015f G\u00fcc\u00fc Politikas\u0131\u201d ibaresi Y\u00c7\u0130HK\u2019 de yer almamakla birlikte Kanun ve Y\u00f6netmelik ile g\u00fcd\u00fclen amac\u0131n bir yans\u0131mas\u0131d\u0131r. \u0130lgili politika hakk\u0131nda Kanun\u2019da bir tan\u0131mlama yer almasa da Y\u00f6netmelik\u2019in 6.maddesi i\u015fbu politika ile izlenen ama\u00e7lar\u0131 a\u00e7\u0131k ve net bir \u015fekilde ifade etmektedir.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u0130lgili maddeye g\u00f6re; uluslararas\u0131 i\u015f g\u00fcc\u00fc politikas\u0131 T\u00fcrkiye\u2019nin ihtiya\u00e7 duydu\u011fu i\u015fg\u00fcc\u00fcn\u00fcn \u00f6ncelikle yerli i\u015f g\u00fcc\u00fcnden kar\u015f\u0131lanmas\u0131na y\u00f6nelik geli\u015ftirilecek politikalar\u0131n yan\u0131 s\u0131ra uluslararas\u0131 istihdam politikalar\u0131n\u0131n s\u00fcrd\u00fcr\u00fclebilirli\u011fini hedeflemektedir. Bu hedef ile yerli ve yabanc\u0131 i\u015f g\u00fcc\u00fc dengesi kurulabilecek ve nitelikli yabanc\u0131 i\u015f g\u00fcc\u00fcnden de yararlan\u0131labilecektir. Ayr\u0131ca stratejik \u00f6neme haiz herhangi bir alanda \u00f6ne \u00e7\u0131km\u0131\u015f y\u00fcksek nitelikli yabanc\u0131 i\u015f g\u00fcc\u00fc ve yat\u0131r\u0131mc\u0131n\u0131n \u00fclkeye kazand\u0131r\u0131lmas\u0131 da izlenen ama\u00e7lar aras\u0131nda yer almaktad\u0131r. Nitekim Y\u00f6netmelik\u2019in 32.maddesinde nitelikli i\u015f g\u00fcc\u00fc ve nitelikli yabanc\u0131 yat\u0131r\u0131mlar\u0131n tespitinde aranacak \u015fartlara yer verilmi\u015ftir.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">S\u00f6z konusu politika ile uluslararas\u0131 istihdam\u0131n s\u00fcrd\u00fcr\u00fclebilirli\u011fi hedeflendi\u011finden yabanc\u0131 i\u015f g\u00fcc\u00fcn\u00fcn \u00fclkeye \u00e7ekilmesi ad\u0131na Y\u00f6netmelik\u2019te \u00f6nemli ve bir tak\u0131m kolayla\u015ft\u0131r\u0131c\u0131 d\u00fczenlemelerin yer ald\u0131\u011f\u0131 g\u00f6r\u00fclmektedir.\u00a0<\/span><\/p>\n<p><b>Eski Uygulama ve Y\u00f6netmelik\u2019in Getirdi\u011fi Dikkat \u00c7ekici Unsurlar:<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Y\u00f6netmelik, \u00e7al\u0131\u015fma izni ba\u015fvurular\u0131n\u0131n reddedilmesi halinde itiraz s\u00fcrecine ili\u015fkin yeni bir d\u00fczenlemeyi kapsamaktad\u0131r. Y\u00f6netmeli\u011fin 66.maddesi ile s\u00fcre ve usul y\u00f6n\u00fcnden olduk\u00e7a \u00f6nemli bir de\u011fi\u015fiklik getirilmi\u015ftir. Bu kapsamda; Bakanl\u0131\u011f\u0131n Kanun ve Y\u00f6netmelik kapsam\u0131nda verdi\u011fi kararlara kar\u015f\u0131 ilgililer taraf\u0131ndan karar\u0131n tebli\u011f tarihinden itibaren 30 g\u00fcn i\u00e7erisinde itiraz edilebilecektir. \u0130tirazlar \u201csistem\u201d \u00fczerinden ger\u00e7ekle\u015ftirilecek, itiraz\u0131n reddedilmesi halinde ise idari yarg\u0131 yoluna ba\u015fvurulmas\u0131 m\u00fcmk\u00fcn hale getirilmi\u015ftir.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Y\u00f6netmelik\u2019in 11.maddesine g\u00f6re yabanc\u0131lar\u0131n \u00e7al\u0131\u015fma izni, \u00e7al\u0131\u015fma muafiyet ba\u015fvurular\u0131 ile di\u011fer ba\u015fvurular\u0131n al\u0131nmas\u0131na, de\u011ferlendirilmesine, sonu\u00e7land\u0131r\u0131lmas\u0131na ili\u015fkin t\u00fcm i\u015f ve i\u015flemler \u201celektronik ortam\u201d da \u201csistem\u201d \u00fczerinden yap\u0131l\u0131r. Bununla birlikte Y\u00f6netmelik\u2019in 11\/3.bendi uluslararas\u0131 i\u015fg\u00fcc\u00fc hareketlili\u011fine dair t\u00fcm verilerin sistem \u00fczerinde saklanaca\u011f\u0131n\u0131 d\u00fczenlemektedir. Getirilen sistem d\u00fczenlemesi; \u015f\u00fcphesiz ki, uluslararas\u0131 i\u015f g\u00fcc\u00fc politikas\u0131n\u0131n uygulanmas\u0131n\u0131 kolayla\u015ft\u0131racakt\u0131r. Zira ilgili i\u015f ve i\u015flemlerin elektronik ortam \u00fczerinden y\u00fcr\u00fcmesi s\u00fcre\u00e7lerin h\u0131z\u0131n\u0131 art\u0131racak, uluslararas\u0131 istihdam\u0131n kay\u0131t alt\u0131na al\u0131nmas\u0131 ad\u0131na g\u00fcvenli bir ortam olu\u015fturacakt\u0131r.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Y\u00f6netmelik\u2019in 15.maddesine g\u00f6re Genel M\u00fcd\u00fcrl\u00fck taraf\u0131ndan belirlenecek yabanc\u0131lardan T\u00fcrkiye\u2019de bulunanlar ge\u00e7erli bir ikamet izni olmaks\u0131z\u0131n sistem \u00fczerinden \u00e7al\u0131\u015fma izni i\u00e7in ba\u015fvuruda bulunabilecektir. S\u00f6z konusu d\u00fczenleme Y\u00c7\u0130HK\u2019 in uygulama y\u00f6netmeli\u011finde yer almayan yeni bir de\u011fi\u015fikliktir.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Bu noktada i\u015fbu maddenin uygulanabilirli\u011fi a\u00e7\u0131s\u0131ndan Y\u00f6netmelik\u2019in 15.maddesinde bahsi ge\u00e7en yabanc\u0131lar\u0131n hangi niteliklere sahip olaca\u011f\u0131, yabanc\u0131y\u0131 istihdam eden i\u015fverenin ve\/veya i\u015fyerinin sahip olmas\u0131 gereken \u00f6zellikler ve yap\u0131lacak ba\u015fvurunun uluslararas\u0131 i\u015f g\u00fcc\u00fc politikas\u0131na uygunlu\u011funa ili\u015fkin hususlar dikkate al\u0131narak bir tak\u0131m \u00f6zel \u015fartlar belirlenecek ve bu \u015fartlar alt\u0131 ayl\u0131k d\u00f6nemlerle g\u00fcncellenip resmi internet sayfas\u0131nda Genel M\u00fcd\u00fcrl\u00fck taraf\u0131ndan yay\u0131mlanacakt\u0131r. Eski Y\u00c7\u0130HK uygulamas\u0131na g\u00f6re; yabanc\u0131lar\u0131n yurti\u00e7inden \u00e7al\u0131\u015fma izni ba\u015fvurusunda bulunabilmesi i\u00e7in en az 6 ay ge\u00e7erli ikamet tezkeresinin bulunmas\u0131 gerekmekteydi. Genel M\u00fcd\u00fcrl\u00fck taraf\u0131ndan belirlenecek yabanc\u0131lara ili\u015fkin s\u0131n\u0131rlaman\u0131n istisnai nitelikte oldu\u011fu da unutulmamal\u0131d\u0131r. Zira s\u00f6z konusu istisna d\u0131\u015f\u0131nda yurti\u00e7inden yap\u0131lacak t\u00fcm ba\u015fvurularda ge\u00e7erli en az 6 ay s\u00fcreli ikamet izni \u015fart\u0131 halen varl\u0131\u011f\u0131n\u0131 korumaktad\u0131r.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Bununla birlikte Y\u00f6netmelik\u2019in \u201c\u015eube veya G\u00f6rev De\u011fi\u015fikli\u011fi\u201d ba\u015fl\u0131kl\u0131 26. maddesi uluslararas\u0131 istihdam\u0131n \u00fclke i\u00e7erisindeki s\u00fcrd\u00fcr\u00fclebilirli\u011fi a\u00e7\u0131s\u0131ndan son derece dikkat \u00e7ekicidir. \u0130lgili d\u00fczenleme ile bir i\u015fverene ba\u011fl\u0131 olarak \u00e7al\u0131\u015fma izni verilen yabanc\u0131n\u0131n ayn\u0131 i\u015fverene ait i\u015fyerinde farkl\u0131 bir g\u00f6revde veya bu i\u015fverenin ayn\u0131 i\u015f kolundaki di\u011fer \u015fubelerinde \u00e7al\u0131\u015fabilmesi i\u00e7in sistem \u00fczerinden de\u011fi\u015fiklik ba\u015fvurusunda bulunmas\u0131 m\u00fcmk\u00fcn hale getirilmi\u015ftir.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ayr\u0131ca Y\u00f6netmelik\u2019in 30.maddesinde yer alan \u201c\u00c7al\u0131\u015fma \u0130zninin Ask\u0131ya Al\u0131nmas\u0131\u201d ba\u015fl\u0131\u011f\u0131na de\u011finmek de uygun olacakt\u0131r. \u0130lgili maddeye g\u00f6re bir i\u015fverene ba\u011fl\u0131 olarak verilen \u00e7al\u0131\u015fma izninde; i\u015f kazas\u0131, hastal\u0131k, anal\u0131k, zorunlu kamu hizmeti gibi \u00fccretsiz izin verilmesini zorunlu k\u0131lan haller hari\u00e7 olmak \u00fczere i\u015fveren ve yabanc\u0131 \u00e7al\u0131\u015fan kar\u015f\u0131l\u0131kl\u0131 \u015fekilde anla\u015f\u0131p en fazla 90 g\u00fcn s\u00fcreyle i\u015f akdini ask\u0131ya alabilir. \u00c7al\u0131\u015fma izninin ask\u0131ya al\u0131nabilece\u011fi meslek ve sekt\u00f6rler ise Genel M\u00fcd\u00fcrl\u00fck taraf\u0131ndan belirlenmektedir.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Bununla birlikte, Y\u00f6netmelik\u2019in 28.maddesi \u201cS\u00fcresiz \u00c7al\u0131\u015fma \u0130zni\u201d ba\u015fl\u0131\u011f\u0131 alt\u0131nda T\u00fcrkiye\u2019de uzun d\u00f6nem ikamet izni veya en az sekiz y\u0131l kanuni \u00e7al\u0131\u015fma izni olan yabanc\u0131lar\u0131n s\u00fcresiz \u00e7al\u0131\u015fma izni i\u00e7in ba\u015fvuruda bulunabilece\u011fini d\u00fczenlemektedir. \u0130lgili Y\u00f6netmelik Y\u00c7\u0130HK\u2019 nin uygulama y\u00f6netmeli\u011finden farkl\u0131 olarak s\u00fcresiz \u00e7al\u0131\u015fma izni belgelerinin \u00e7al\u0131\u015fma izni ba\u015flang\u0131\u00e7 tarihi itibariyle her be\u015f y\u0131l\u0131n sonunda yenilenece\u011fini h\u00fck\u00fcm alt\u0131na almaktad\u0131r. \u0130lgili belgenin yenileme ba\u015fvurusunun ise 5 y\u0131ll\u0131k s\u00fcrenin dolmas\u0131ndan 6 ay \u00f6nce yap\u0131lmas\u0131 gerekmektedir.
