Genel \u00c7er\u00e7eve<\/strong><br \/>\nAvrupa Parlamentosu, 21 Ocak 2021\u2019de \u00e7al\u0131\u015fanlar\u0131n \u201c\u0130rtibat\u0131 Kesme Hakk\u0131\u201d kapsam\u0131nda tavsiyeler i\u00e7eren bir rapor yay\u0131nlanm\u0131\u015ft\u0131r. Bu raporun haz\u0131rlanmas\u0131nda, \u00e7al\u0131\u015fanlar\u0131n irtibat\u0131 kesme hakk\u0131na y\u00f6nelik belirli bir birlik yasas\u0131n\u0131n bulunmamas\u0131, i\u015f hayat\u0131n\u0131n dijitalle\u015fmesi ile birlikte i\u015f ve \u00f6zel hayat s\u0131n\u0131rlar\u0131n\u0131n bulan\u0131kla\u015fmas\u0131, dijital ara\u00e7lar\u0131n i\u015f ama\u00e7lar\u0131 i\u00e7in her zamankinden daha fazla kullan\u0131lmas\u0131, \u00e7al\u0131\u015fanlar\u0131n temel ve adil \u00e7al\u0131\u015fma haklar\u0131 \u00fczerinde &#8216;s\u00fcrekli ba\u011flant\u0131l\u0131&#8217;, &#8216;her zaman a\u00e7\u0131k&#8217; veya &#8216;s\u00fcrekli g\u00f6rev ba\u015f\u0131nda&#8217; gibi zararl\u0131 etkiye sahip olabilen kullan\u0131mlarda art\u0131\u015f\u0131n meydana gelmesi, dijital ara\u00e7lar\u0131n uzun s\u00fcre kullan\u0131lmas\u0131 sonucunda konsantrasyon azalmas\u0131na ve ayr\u0131ca bili\u015fsel ve duygusal a\u015f\u0131r\u0131 y\u00fcklenmeye neden olmas\u0131 gibi nedenler rol alm\u0131\u015ft\u0131r. Bu rapor her ne kadar birli\u011fe \u00fcye \u00fclkelere bu konuda bir aksiyona almalar\u0131na dair bir tavsiye niteli\u011finde olsa da rapor sonras\u0131nda, \u00e7al\u0131\u015fan\u0131n irtibat\u0131 kesme hakk\u0131, d\u00fcnya \u00e7ap\u0131nda pop\u00fclerle\u015ferek b\u00fcy\u00fck bir ilgi ile tart\u0131\u015f\u0131lmaya ba\u015flanm\u0131\u015ft\u0131r. Raporda \u00e7al\u0131\u015fan\u0131n irtibat\u0131 kesme hakk\u0131, kapsaml\u0131 bir \u015fekilde, t\u00fcm gereklilikleri ile birlikte bir\u00e7ok farkl\u0131 y\u00f6nleriyle ele al\u0131nm\u0131\u015f ve neticesinde 14 maddelik bir taslak Direktife yer<br \/>\nverilmi\u015ftir.<\/p>\n<p><strong>B. \u0130rtibat Kesme Hakk\u0131 Nedir?<\/strong><br \/>\n\u201c\u0130rtibat\u0131 Kesme Hakk\u0131\u201d, \u00e7al\u0131\u015fanlar\u0131n telefon g\u00f6r\u00fc\u015fmeleri, e-postalar veya di\u011fer mesajlar gibi dijital ara\u00e7lar arac\u0131l\u0131\u011f\u0131yla \u00e7al\u0131\u015fma saatleri d\u0131\u015f\u0131nda i\u015fle ilgili faaliyetlerde bulunmama veya ileti\u015fim kurmama hakk\u0131n\u0131 ifade etmekle birlikte \u00f6zel hayat ile i\u015f hayat\u0131n\u0131n ayr\u0131\u015ft\u0131r\u0131lmas\u0131n\u0131n sa\u011flanmas\u0131n\u0131 ama\u00e7lamaktad\u0131r. Dijital \u00e7a\u011fdaki yeni \u00e7al\u0131\u015fma modellerinin ayr\u0131lmaz bir par\u00e7as\u0131 olan temel bir hak olarak ele al\u0131nmaktad\u0131r. \u0130rtibat\u0131 kesme hakk\u0131 kapsam\u0131nda, \u00e7al\u0131\u015fanlar\u0131n dinlenme s\u00fcreleri, resmi ve y\u0131ll\u0131k tatilleri, annelik, babal\u0131k izinleri d\u00e2hil olmak \u00fczere \u00e7al\u0131\u015fma saatleri d\u0131\u015f\u0131ndaki s\u00fcrelerde telefon g\u00f6r\u00fc\u015fmeleri, e-postalar ve di\u011fer mesajlar gibi i\u015fle ilgili g\u00f6revler, faaliyetler ve elektronik ileti\u015fimden ka\u00e7\u0131nmalar\u0131na izin verdi\u011fi raporda \u00f6zellikle vurgulanmaktad\u0131r. Bu kriterler \u00e7er\u00e7evesinde Avrupa Parlamentosu, t\u00fcm \u00e7al\u0131\u015fanlar\u0131n korunmas\u0131n\u0131 sa\u011flamak amac\u0131yla \u201c\u0130rtibat Kesme Hakk\u0131\u201dn\u0131n Birlik d\u00fczeyinde bir sosyal politika arac\u0131 olarak g\u00f6r\u00fclmesi gerekti\u011fini dile getirmi\u015ftir.<\/p>\n<p><strong>C. Kapsam ve Sonu\u00e7<\/strong><br \/>\nParlamento\u2019nun yay\u0131nlam\u0131\u015f oldu\u011fu raporda \u00fczerinde durulan temel konular, \u00e7al\u0131\u015fanlar\u0131n i\u015f ya\u015famlar\u0131 ve \u00f6zel ya\u015famlar\u0131n\u0131n ayr\u0131\u015ft\u0131r\u0131lmas\u0131, \u00e7al\u0131\u015fanlar\u0131n fiziksel ve psikolojik durumlar\u0131n\u0131 etkileme, fazla mesai ve \u00fccretlerdir. Dijitalle\u015fme ve dijital ara\u00e7lar\u0131n kullan\u0131m\u0131 i\u015fverenlere ve i\u015f\u00e7ilere i\u015f ya\u015fam\u0131nda artan esneklik ve \u00f6zerklik, i\u015f-ya\u015fam dengesini geli\u015ftirme potansiyeli ve i\u015fe gidi\u015f geli\u015f s\u00fcrelerinin k\u0131salt\u0131lmas\u0131 gibi bir\u00e7ok ekonomik ve toplumsal fayda ve avantaj getirirken ayn\u0131 zamanda dezavantajlar\u0131 da beraberinde getirdi\u011fi i\u015fin yo\u011funla\u015ft\u0131r\u0131lmas\u0131 ve \u00e7al\u0131\u015fma saatlerinin uzat\u0131lmas\u0131, b\u00f6ylece i\u015f ve \u00f6zel hayat aras\u0131ndaki s\u0131n\u0131rlar\u0131n bulan\u0131kla\u015ft\u0131r\u0131lmas\u0131 gibi bir dizi etik, yasal ve istihdamla ilgili zorluklara sebep oldu\u011fu tespit edilmi\u015ftir. Adil \u00fccretlendirme, \u00e7al\u0131\u015fma s\u00fcresinin s\u0131n\u0131rland\u0131r\u0131lmas\u0131 ve i\u015f-ya\u015fam dengesinin sa\u011flanmas\u0131 amac\u0131yla bu dijital ge\u00e7i\u015fin temel haklar\u0131na ve \u00f6zellikle de insan haklar\u0131 de\u011ferlerine uygun \u015fekilde y\u00f6nlendirilmesi gerekti\u011fini dile getirilmi\u015f ayr\u0131ca bu dijital ara\u00e7lar\u0131n uzun s\u00fcre kullan\u0131lmas\u0131 konsantrasyonun azalmas\u0131na ve bili\u015fsel\/duygusal a\u015f\u0131r\u0131 y\u00fcklenmeye sebep oldu\u011fu belirtilmi\u015ftir. Psikolojik ve fiziksel etkilerine de\u011finilen raporda, teknolojik cihazlar\u0131n a\u015f\u0131r\u0131 kullan\u0131m\u0131n\u0131n soyutlanma, tekno ba\u011f\u0131ml\u0131l\u0131k, uykusuzluk, yorgunluk, kayg\u0131 ve t\u00fckenmi\u015flik gibi olgular\u0131 da a\u011f\u0131rla\u015ft\u0131rabildi\u011fini belirtmi\u015flerdir. Raporda yer verilen D\u00fcnya Sa\u011fl\u0131k \u00d6rg\u00fct\u00fc\u2019n\u00fcn a\u00e7\u0131klamalar\u0131na g\u00f6re ise, d\u00fcnya \u00e7ap\u0131nda 300 milyondan fazla insan depresyondan ve i\u015fle ilgili yayg\u0131n ruhsal hastal\u0131klardan muzdarip oldu\u011fu, Avrupa Birli\u011fi n\u00fcfusunun ise %32\u2019si her y\u0131l bir ruhsal<br \/>\nhastal\u0131klardan muzdarip oldu\u011fu belirtilmi\u015ftir. \u00c7al\u0131\u015fanlar\u0131n ba\u011flant\u0131lar\u0131n\u0131 kesme hakk\u0131n\u0131n fiziksel ve zihinsel sa\u011fl\u0131klar\u0131n\u0131 ve refahlar\u0131n\u0131 korumalar\u0131 ve onlar\u0131 psikolojik risklerden korumak i\u00e7in hayati \u00f6nem ta\u015f\u0131d\u0131\u011f\u0131, \u00e7\u00fcnk\u00fc s\u00fcrekli ba\u011flanabilirlik, y\u00fcksek i\u015f talepleri ve \u00e7al\u0131\u015fanlar\u0131n her an ula\u015f\u0131labilir oldu\u011funa dair artan beklenti ile birlikte, \u00e7al\u0131\u015fanlar\u0131n temel haklar\u0131n\u0131, i\u015f-ya\u015fam dengelerini, fiziksel ve zihinsel sa\u011fl\u0131klar\u0131n\u0131 ve refahlar\u0131n\u0131 olumsuz etkileyebildi\u011fine \u0131\u015f\u0131k tutulmu\u015ftur.<br \/>\nBir di\u011fer raporda yer verilen, Avrupa Ya\u015fam ve \u00c7al\u0131\u015fma Ko\u015fullar\u0131n\u0131 \u0130yile\u015ftirme Vakf\u0131\u2019n\u0131n (Eurofund) ara\u015ft\u0131rmas\u0131na g\u00f6re; evden \u00e7al\u0131\u015fanlar\u0131n %27\u2019si i\u015f taleplerini kar\u015f\u0131lamak i\u00e7in bo\u015f zamanlar\u0131nda da<br \/>\n\u00e7al\u0131\u015fmaktad\u0131rlar. Burada \u00e7al\u0131\u015fanlar\u0131n en temel hakk\u0131 olan dinlenme hakk\u0131 sorunu ortaya \u00e7\u0131kmaktad\u0131r. \u00c7al\u0131\u015fma s\u00fcrelerinin (AB kurallar\u0131na g\u00f6re haftal\u0131k 48 saat) anla\u015f\u0131lan yasal s\u0131n\u0131rlar i\u00e7inde kalmas\u0131na dikkat edilmesi gerekti\u011fi, \u00e7al\u0131\u015fma s\u00fcreleri bu s\u00fcrelerin a\u015f\u0131lmamas\u0131 amac\u0131yla uygun bir \u015fekilde tutulmas\u0131 gerekti\u011fi belirtilmi\u015ftir. Parlamento \u201c\u0130rtibat Kesme Hakk\u0131\u201dna toplumsal cinsiyet ba\u011flam\u0131nda da dikkat edilmesi gerekti\u011fini vurgulam\u0131\u015ft\u0131r. Bu sebeple de daha iyi bir i\u015f-ya\u015fam dengesi yarat\u0131lmas\u0131 i\u00e7in i\u015f\u00e7ilerin ihtiya\u00e7lar\u0131n\u0131n b\u00fcy\u00fck \u00f6l\u00e7\u00fcde farkl\u0131 oldu\u011funun g\u00f6r\u00fclmesi ve bu ba\u011flamda ki\u015fisel esnekli\u011fin ve ayn\u0131 zamanda i\u015f\u00e7ilerin haklar\u0131n\u0131n korunmas\u0131n\u0131 te\u015fvik eden net bir \u00e7er\u00e7eve geli\u015ftirmesi gerekti\u011fi, ba\u011flanabilirlik ve ula\u015f\u0131labilirlik seviyelerinin i\u015fe alma veya kariyer geli\u015fimi a\u00e7\u0131s\u0131ndan bir ayr\u0131mc\u0131l\u0131k unsuru olu\u015fturmamas\u0131 gerekti\u011fi vurgulanm\u0131\u015ft\u0131r. \u00d6nemli bir nokta ise sadece i\u015fverenlerin de\u011fil \u00e7al\u0131\u015fanlar\u0131n i\u015f arkada\u015flar\u0131n\u0131n da i\u015fle ilgili konular hakk\u0131nda \u00e7al\u0131\u015fma saatleri d\u0131\u015f\u0131nda meslekta\u015flar\u0131yla ileti\u015fim kurmaktan ka\u00e7\u0131nma haklar\u0131n\u0131n bulundu\u011funun belirlenmesidir.
